AMENDMENT TO HOUSE BILL 3949

AMENDMENT NO. ______. Amend House Bill 3949 by replacing everything after the enacting clause with the following:

"Section 5. The Department of Public Health Powers and Duties Law of the Civil Administrative Code of Illinois is amended by adding Section 2310-431 as follows:

(20 ILCS 2310/2310-431 new)

Sec. 2310-431. Homeless service providers.

(a) In this Section, "homeless service provider" means a person or entity who provides services to homeless persons under any of the programs of or identified by the Department of Human Services.

(b) The Department shall consider all homeless service providers in the State to be essential critical infrastructure workers under the federal Cybersecurity and Infrastructure Security Agency's "Essential Critical Infrastructure Workers Guidance Version 4.0". The Department shall ensure that homeless service providers qualify for the same priority benefits afforded to health care organizations and frontline workers by the State, including, but not limited to:

(1) federal COVID-19 relief funding;

(2) personal protective equipment; and

(3) vaccinations.

(c) The Department may adopt rules for the implementation and administration of this Section and to ensure that homeless service providers are considered essential critical infrastructure workers in the event of a pandemic.

Section 99. Effective date. This Act takes effect upon becoming law.".
