AMENDMENT TO HOUSE BILL 5187

2    AMENDMENT NO. ______. Amend House Bill 5187 by replacing
3everything after the enacting clause with the following:
 
4    "Section 5. The Employee Washroom Act is amended by adding
5Section 0.05 as follows:
 
6    (820 ILCS 230/0.05 new)
7    Sec. 0.05. Federal regulations; operation of Act.
8    (a) Except as provided in subsection (b), Sections 1
9through 5 of this Act are inoperative on and after the
10effective date of this amendatory Act of the 102nd General
11Assembly.
12    (b) If at any time the Occupational Safety and Health
13standard at 29 CFR 1910.141 is repealed or revoked, the
14Director of Labor shall adopt a rule setting forth a
15determination that this Act should be reviewed and reinstated
16in order to protect the health and safety of Illinois'

1workers. On the date such a rule is adopted, this Act shall
2again become operative.
 
3    Section 10. The Work Under Compressed Air Act is amended
4by adding Section 1.5 as follows:
 
5    (820 ILCS 245/1.5 new)
6    Sec. 1.5. Federal regulations; operation of Act.
7    (a) Except as provided in subsection (b), Sections 1
8through 6 of this Act are inoperative on and after the
9effective date of this amendatory Act of the 102nd General
10Assembly.
11    (b) If at any time the Safety and Health Regulations for
12Construction standards at 29 CFR 1926.800 through 29 CFR
131926.804 are repealed or revoked, the Director of Labor shall
14adopt a rule setting forth a determination that this Act
15should be reviewed and reinstated, in whole or in part, in
16order to protect the health and safety of Illinois' workers.
17On the date such a rule is adopted, this Act shall again become
18operative.
 
19    Section 15. The Underground Sewer Employee Safety Act is
20amended by changing Section 1 and by adding Section 0.05 as
21follows:

2    (a) Except as provided in subsection (b), Sections 1
3through 6 of this Act are inoperative on and after the
4effective date of this amendatory Act of the 102nd General
5Assembly.
6    (b) If at any time the Occupational Safety and Health
7standards at 29 CFR 1910.120, 29 CFR 1910.146 or the Safety and
8Health Regulations for Construction standards 29 CFR 1926.1201
9through 29 CFR 1926.1213 are repealed or revoked, the Director
10of Labor shall adopt a rule setting forth a determination that
11this Act should be reviewed and reinstated, in whole or in
12part, in order to protect the health and safety of Illinois'
13workers. On the date such a rule is adopted, this Act shall
14again become operative.

16    Sec. 1. This Act shall apply to all employers engaged in
17any occupation, business or enterprise in this State,
18including the State of Illinois and its political
19subdivisions, except that in the event of a conflict between
20this Act and any other Federal or State law or regulation
21concerning health and safety of employees, such other law or
22regulation shall control.

24    Section 20. The Toxic Substances Disclosure to Employees

1Act is amended by changing Section 1.5 as follows:
 
2    (820 ILCS 255/1.5)
3    Sec. 1.5. Federal regulations; operation of Act.
4    (a) Except as provided in subsection (b), Sections 2
5through 17 of this Act are inoperative on and after the
6effective date of this amendatory Act of the 102nd 95th
7General Assembly, and the Department of Labor shall instead
8enforce the Occupational Safety and Health Administration
9Hazard Communication standards at 29 CFR 1910.1200, as
10amended.
11    (b) If at any time the Occupational Safety and Health
12Administration Hazard Communication standard at 29 CFR
131910.1200 is repealed or revoked, the Director of Labor shall
14adopt a rule setting forth a determination that this Act
15should be reviewed and reinstated in order to protect the
16health and safety of Illinois' public sector workers. On the
17date such a rule is adopted, this Act shall again become
18operative.
