SYNOPSIS AS INTRODUCED:
 
105 ILCS 5/27-2.5 new

    Amends the School Code. Allows a school board to discontinue, by publicly adopted resolution, any instructional mandate in the Courses of Study Article of the School Code unless a separate State appropriation is made for the school district that provides full funding for the specific instructional mandate (with exceptions). Provides that if a student requests information on any instructional mandate that has been discontinued, then the school district shall provide the student with the requested information. Effective immediately.

1    AN ACT concerning education.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 5. The School Code is amended by adding Section
527-2.5 as follows:
 
6    (105 ILCS 5/27-2.5 new)
7    Sec. 27-2.5. Instructional mandate discontinuance.
8    (a) For the purposes of this Section, "instructional
9mandate" means any State law in this Article that requires a
10school district to devote any amount of time to the
11instruction of or engagement by students in a subject or
12course.
13    (b) Notwithstanding Section 2-3.25g or any other provision
14of this Code, a school board may discontinue, by publicly
15adopted resolution, any instructional mandate in this Article
16unless a separate State appropriation, other than funding
17received by the school district under Section 18-8.15 of this
18Code, is made for the school district that provides full
19funding for the specific instructional mandate. This Section,
20however, does not permit a school board to discontinue by
21resolution the requirements set forth in Sections 27-5, 27-6,
2227-7, and 27-22 of this Code and Sections 27-24 through
2327-24.8 of this Code.

1    (c) If a student requests information on any instructional
2mandate that has been discontinued under this Section, then
3the school district shall provide the student with the
4requested information.
5    (d) The State Board of Education may adopt any rules that
6it deems necessary for the implementation of this Section.
 
7    Section 99. Effective date. This Act takes effect upon
8becoming law.
