SYNOPSIS AS INTRODUCED:
 
15 ILCS 205/6.7 new

    Amends the Attorney General Act. Creates within the Office of the Attorney General an Independent Investigative Unit for the purpose of investigating all alleged or potential police–involved deaths of civilians. Provides that the Independent Investigative Unit may also investigate any other crimes related to police misconduct that are discovered during an investigation, and may act with the full powers, rights, privileges, and duties of a State's Attorney. Requires the Independent Investigative Unit to transmit a report containing detailed investigative findings to the State's Attorney of the county that has jurisdiction to prosecute the matter. Requires law enforcement agencies to notify the Independent Investigative Unit of any alleged or potential police-involved death of a civilian as soon as the law enforcement agency becomes aware of the incident. Defines "law enforcement agency".

1    AN ACT concerning State government.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 5. The Attorney General Act is amended by adding
5Section 6.7 as follows:
 
6    (15 ILCS 205/6.7 new)
7    Sec. 6.7. Independent Investigative Unit for
8Police-involved Deaths.
9    (a) There is created within the Office of the Attorney
10General an Independent Investigative Unit for the purpose of
11investigating all alleged or potential police–involved deaths
12of civilians. The Independent Investigative Unit may also
13investigate any other crimes related to police misconduct that
14are discovered during an investigation under this Section, and
15may act with the full powers, rights, privileges, and duties
16of a State's Attorney, including the use of a grand jury in any
17county.
18    (b) Within 15 days after completing an investigation under
19this Section, the Independent Investigative Unit shall
20transmit a report containing detailed investigative findings
21to the State's Attorney of the county that has jurisdiction to
22prosecute the matter. Except as otherwise provided by law, the
23report shall remain confidential through adjudication of any

1associated criminal case at the trial court level.
2    (c) To investigate and assist with the investigation of
3alleged criminal offenses committed by police officers, the
4Independent Investigative Unit may: (i) detail one or more
5police officers employed by the Illinois State Police; and
6(ii) employ other civilian personnel as needed.
7    (d) For purposes of investigations conducted under this
8Section, a law enforcement agency shall cooperate with the
9Independent Investigative Unit in connection with the
10investigation of a police–involved death of a civilian, and
11shall notify the Independent Investigative Unit of any alleged
12or potential police-involved death of a civilian as soon as
13the law enforcement agency becomes aware of the incident.
14    (e) For purposes of this Section, "law enforcement agency"
15means an agency of this State or unit of local government which
16is vested by law or ordinance with the duty to maintain public
17order and to enforce criminal laws or ordinances.
