SYNOPSIS AS INTRODUCED:
 
305 ILCS 5/5-2.07

    Amends the Medical Assistance Article of the Illinois Public Aid Code. Provides that a person who uses Medicaid spend-down to qualify for medical assistance shall not be eligible for medical assistance if the person does not meet his or her monthly spend-down for 6 consecutive months. Effective immediately.

1    AN ACT concerning public aid.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 5. The Illinois Public Aid Code is amended by
5changing Section 5-2.07 as follows:
 
6    (305 ILCS 5/5-2.07)
7    Sec. 5-2.07. Use of Medicaid spend-down. No later than
8July 1, 2007, subject to federal approval of a State Medicaid
9Plan amendment, which shall be sought by the Department of
10Healthcare and Family Services or its successor agency,
11persons described in item 2(a) of Section 5-2, who fail to
12qualify for basic maintenance under Article III of this Code
13on the basis of need because of excess income or assets, or
14both, may establish eligibility for medical assistance by
15paying the amount of their monthly spend-down under this
16Article (as described in 42 CFR 435.831) to the Department of
17Healthcare and Family Services or its successor agency or by
18having a third party pay that amount to the Department on their
19behalf. A person who uses Medicaid spend-down to qualify for
20medical assistance shall not be eligible for medical
21assistance if the person does not meet his or her monthly
22spend-down for 6 consecutive months.

1    Section 99. Effective date. This Act takes effect upon
2becoming law.
