AMENDMENT TO SENATE BILL 257

2    AMENDMENT NO. ______. Amend Senate Bill 257 by replacing
3everything after the enacting clause with the following:
 
4    "Section 5. The Illinois Marriage and Dissolution of
5Marriage Act is amended by changing Section 607.6 as follows:
 
6    (750 ILCS 5/607.6)
7    Sec. 607.6. Court-ordered counseling. Counseling.
8    (a) The court may order individual counseling for the
9child, family counseling for one or more of the parties and the
10child, or parental education for one or more of the parties, if
11it finds one or more of the following:
12        (1) both parents or all parties agree to the order;
13        (2) the child's physical health is endangered or that
14    the child's emotional development is impaired;
15        (3) abuse of allocated parenting time under Section
16    607.5 has occurred; or

1        (4) one or both of the parties have violated the
2    allocation judgment with regard to conduct affecting or in
3    the presence of the child.
4    (b) The court may apportion the costs of counseling
5between the parties as appropriate.
6    (c) The remedies provided in this Section are in addition
7to, and do not diminish or abridge in any way, the court's
8power to exercise its authority through contempt or other
9proceedings.
10    (d) Counseling ordered under this Section is subject to
11the Mental Health and Developmental Disabilities
12Confidentiality Act and the federal Health Insurance
13Portability and Accountability Act of 1996. All counseling
14sessions shall be confidential. The communications in
15counseling shall not be used in any manner in litigation nor
16relied upon by any expert appointed by the court or retained by
17any party.

19    Section 99. Effective date. This Act takes effect upon
20becoming law.".
