Creates the Student Parent Data Collection Act. Beginning September 1, 2021, requires each public institution of higher education to determine the parental status of each of its enrolled students and collect specified information about the student if the student indicates that the student is a parent. Beginning September 1, 2021, requires each public institution of higher education that operates one or more child care centers or early learning centers on its campus or is otherwise affiliated with a child care center or early learning center to collect specified information concerning the number of children served. Sets forth reporting and privacy requirements. Effective July 1, 2021.

| 2 | | Be it enacted by the People of the State of Illinois,
| 3 | | represented in the General Assembly:
| 4 | | Section 1. Short title. This Act may be cited as the | 5 | | Student Parent Data Collection Act. | 6 | | Section 5. Definitions. In this Act: | 7 | | "Parent" means the parent or legal guardian of a child who | 8 | | is under the age of 18 years or the parent or legal guardian of | 9 | | an individual with special needs of any age. | 10 | | "Public institution of higher education" or "institution" | 11 | | means a public community college or public university in this | 12 | | State.
| 13 | | Section 10. Student parent data collection. | 14 | | (a) Beginning September 1, 2021, each public institution | 15 | | of higher education shall determine the parental status of | 16 | | each of its enrolled students. If a student indicates that the | 17 | | student is a parent, the institution shall collect all of the | 18 | | following information: | 19 | | (1) The student's marital status. | 20 | | (2) The size of the student's immediate family. | 21 | | (3) The age of each of the student's dependents. | 22 | | (4) The student's employment status, including the |

| 1 | | average number of hours worked per week. | 2 | | (5) If any of the student's dependents are enrolled in | 3 | | center-based or home-based child care. | 4 | | (6) If any of the student's dependents are enrolled in | 5 | | on-campus child care. | 6 | | (7) If a student is receiving or has received services | 7 | | through the Department of Human Services' Child Care | 8 | | Assistance Program.
| 9 | | (b) All data collected under subsection (a) must be | 10 | | disaggregated by all variables collected normally, including, | 11 | | but not limited to, the student's race, ethnicity, income, | 12 | | gender, age, enrollment status, type of credential sought, | 13 | | receipt of financial aid, grade point average, persistence | 14 | | toward a degree or credential, and completion outcomes. | 15 | | Section 15. Campus child care. Beginning September 1, | 16 | | 2021, each public institution of higher education that | 17 | | operates one or more child care centers or early learning | 18 | | centers on its campus or is otherwise affiliated with a child | 19 | | care center or early learning center shall collect all of the | 20 | | following information: | 21 | | (1) The total number of children who are served by | 22 | | each child care center or early learning center per | 23 | | semester. | 24 | | (2) The number of children of students who are | 25 | | enrolled at the institution who are served by each child |

| 1 | | care center or early learning center per semester. | 2 | | (3) The number of children of employees of the | 3 | | institution who are served by each child care center or | 4 | | early learning center per semester. | 5 | | (4) The number of children who are served by each | 6 | | child care center or early learning center who use the | 7 | | Department of Human Services' Child Care Assistance | 8 | | Program per semester. | 9 | | (5) The number of children of community members or | 10 | | other persons who are unaffiliated with the institution | 11 | | who are served by each child care center or early learning | 12 | | center per semester.
| 13 | | Section 20. Reporting requirements. | 14 | | (a) On or before July 1, 2022 and annually thereafter, | 15 | | each public university shall report the data collected under | 16 | | Sections 10 and 15 to the Board of Higher Education, and each | 17 | | public community college shall report the data collected under | 18 | | Sections 10 and 15 to the Illinois Community College Board. | 19 | | (b) Each institution, the Board of Higher Education, and | 20 | | the Illinois Community College Board shall make the data | 21 | | reported under subsection (a) publicly available annually on | 22 | | their Internet websites. | 23 | | Section 25. Family Educational Rights and Privacy Act of | 24 | | 1974. The sharing and reporting of data under this Act must be |

| 1 | | in accordance with the requirements of the federal Family | 2 | | Educational Rights and Privacy Act of 1974. Nothing in this | 3 | | Act supersedes the federal Family Educational Rights and | 4 | | Privacy Act of 1974 or rules adopted pursuant to the federal | 5 | | Family Educational Rights and Privacy Act of 1974 or any | 6 | | federal or State laws and rules governing student privacy | 7 | | rights.
| 8 | | Section 99. Effective date. This Act takes effect July 1, | 9 | | 2021.
