Hospitals; psychiatric services. | | 10 | | (a) On and after July 1, 2008, the inpatient, per diem rate | | 11 | | to be paid to a hospital for inpatient psychiatric services | | 12 | | shall be $363.77. | | 13 | | (b) For purposes of this Section, "hospital" means the | | 14 | | following: | | 15 | | (1) Advocate Christ Hospital, Oak Lawn, Illinois. | | 16 | | (2) Barnes-Jewish Hospital, St. Louis, Missouri. |

| | 1 | | (b-5) Notwithstanding any other provision of this Section, | | 2 | | and subject to appropriation, the inpatient, per diem rate to | | 3 | | be paid to all safety-net hospitals for inpatient psychiatric | | 4 | | services on and after January 1, 2021 shall be at least $630. | | 5 | | (b-10) Notwithstanding any other provision of this | | 6 | | Section, effective with dates of service on and after January | | 7 | | 1, 2022, any general acute care hospital with more than 9,500 | | 8 | | inpatient psychiatric Medicaid days in any calendar year shall | | 9 | | be paid the inpatient per diem rate of no less than $630. | | 10 | | (c) No rules shall be promulgated to implement this | | 11 | | Section. For purposes of this Section, "rules" is given the | | 12 | | meaning contained in Section 1-70 of the Illinois | | 13 | | Administrative Procedure Act. | | 14 | | (d) This Section shall not be in effect during any period | | 15 | | of time that the State has in place a fully operational | | 16 | | hospital assessment plan that has been approved by the Centers | | 17 | | for Medicare and Medicaid Services of the U.S. Department of | | 18 | | Health and Human Services.
| | 19 | | (e) On and after July 1, 2012, the Department shall reduce | | 20 | | any rate of reimbursement for services or other payments or | | 21 | | alter any methodologies authorized by this Code to reduce any | | 22 | | rate of reimbursement for services or other payments in | | 23 | | accordance with Section 5-5e. | | 24 | | (Source: P.A. 102-4, eff. 4-27-21.)".
