AMENDMENT TO SENATE BILL 740

2    AMENDMENT NO. ______. Amend Senate Bill 740 by replacing
3everything after the enacting clause with the following:
 
4    "Section 5. The Park Commissioners Land Sale Act is
5amended by changing Section 1 as follows:
 
6    (70 ILCS 1235/1)  (from Ch. 105, par. 113)
7    Sec. 1. Any board of park commissioners having the control
8or supervision of any land, or part thereof, used for a public
9park, golf course, banquet facility, boulevard, or driveway or
10highway, and having any piece or parcel of land not exceeding 3
11acres in area, which shall no longer be needed or deemed
12necessary or useful for the purpose of said park, golf course,
13banquet facility, boulevard, or driveway or highway, may apply
14to the Circuit Court of the county in which such piece or
15parcel of land is situated, by petition in writing for leave to
16sell all or any part of the same. Notice of such application

1shall be given by said board of park commissioners in some
2newspaper published in said county at least ten days before
3the day of the hearing on such application named therein. All
4persons interested may appear before said Circuit Court either
5in person or by attorney at the hearing on such application and
6object to the granting thereof. After hearing all persons
7interested, if said court shall deem the granting of said
8application to be for the public interest, it shall direct
9that the property mentioned in said application, or any part
10thereof, be sold and conveyed by the said board of park
11commissioners for the use of said park, golf course, banquet
12facility, boulevard, or driveway or highway, upon such terms
13and conditions as the said court may think proper.
