AMENDMENT TO SENATE BILL 930

2    AMENDMENT NO. ______. Amend Senate Bill 930 by replacing
3everything after the enacting clause with the following:
 
4    "Section 5. The Illinois Insurance Code is amended by
5changing Section 370c.2 as follows:
 
6    (215 ILCS 5/370c.2)
7    (Section scheduled to be repealed on December 31, 2021)
8    Sec. 370c.2. Task force on disability income insurance;
9parity for behavioral health conditions.
10    (a) As used in this Section, "behavioral health condition"
11means any mental, emotional, nervous, or substance use
12disorder or condition that falls under any of the diagnostic
13categories listed in the mental and behavioral disorders
14chapter of the current edition of the International
15Classification of Disease or that is listed in the most recent
16version of the Diagnostic and Statistical Manual of Mental

1Disorders.
2    (b) The Department shall form a task force to review the
3plans and policies for individual and group short-term and
4long-term disability income insurance issued and offered to
5individuals and employers in this State in order to examine
6the use of such insurance for behavioral health conditions.
7The Task Force shall work cooperatively with the insurance
8industry, community organizations, businesses and business
9coalitions, and advocacy groups to reduce the stigma of
10behavioral health conditions. The task force shall be
11comprised of the following members:
12        (1) 2 representatives of the disability income
13    insurance industry appointed by the Governor.
14        (2) 2 experts in the behavioral health conditions and
15    treatment industry appointed by the Governor.
16        (3) 2 consumers of disability income insurance who
17    have experienced or are experiencing a behavioral health
18    condition appointed by the Governor.
19        (4) One member of the General Assembly appointed by
20    the Speaker of the House of Representatives.
21        (5) One member of the General Assembly appointed by
22    the President of the Senate.
23        (6) One member of the General Assembly appointed by
24    the Minority Leader of the House of Representatives.
25        (7) One member of the General Assembly appointed by
26    the Minority Leader of the Senate.

1    (c) The task force shall elect a chairperson from its
2membership and shall have the authority to determine its
3meeting schedule, hearing schedule, and agendas.
4    (d) Appointments shall be made 90 days after the effective
5date of this amendatory Act of the 101st General Assembly.
6    (e) Members shall serve without compensation and shall be
7adults and residents of Illinois.
8    (f) The task force shall:
9        (1) review existing plans and policies for individual
10    and group short-term and long-term disability income
11    insurance issued, delivered, and offered in the State;
12        (2) compare coverage provided by short-term and
13    long-term disability income insurance policies for
14    behavioral health conditions with coverage provided by
15    such policies for physical conditions and the reasons for
16    differences in coverage;
17        (3) gather information on the cost of requiring
18    individual and group short-term and long-term disability
19    income insurance to cover behavioral health conditions at
20    parity with physical conditions; and
21        (4) provide recommendations on the economic
22    feasibility and cost effectiveness of requiring individual
23    and group short-term and long-term disability income
24    insurance to cover behavioral health conditions.
25    (g) Any of the findings, recommendations, and other
26information determined by the task force to be relevant shall

1be made available on the Department's website.
2    (h) The task force shall submit findings and
3recommendations to the Governor and the General Assembly by
4December 31, 2022 2020.
5    (i) The task force is dissolved and this Section is
6repealed on January 1, 2023 December 31, 2021.
