SYNOPSIS AS INTRODUCED:

30 ILCS 105/6z-124 new

    Amends the State Finance Act. Creates the Cook County Water Infrastructure Fund as a special fund in the State treasury. Provides that, subject to appropriation, moneys in the Fund shall be used by the Environmental Protection Agency to make grants to municipalities to fund infrastructure improvements to facilitate water supplies from Lake Michigan for residents of Cook County. Provides that, in making grants from the Cook County Water Infrastructure Fund, the Agency must prioritize water infrastructure projects in non-supplying municipalities in Cook County over water infrastructure projects in supplying municipalities in Cook County. Defines terms. Effective immediately.

1    AN ACT concerning finance.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 5. The State Finance Act is amended by adding
5Section 5.935 and 6z-124 as follows:
 
6    (30 ILCS 105/5.935 new)
7    Sec. 5.935. The Cook County Water Infrastructure Fund.
 
8    (30 ILCS 105/6z-124 new)
9    Sec. 6z-124. Water supplies from Lake Michigan.
10    (a) As used in this Section:
11    "Non-supplying municipality in Cook County" means a
12municipality in Cook County that receives its water from
13another municipality and does not sell its water to another
14municipality.
15    "Supplying municipality in Cook County" means a
16municipality in Cook County that either receives water
17directly from Lake Michigan or buys its water from another
18municipality and then sells some of its water to another
19municipality.
20    (b) The Cook County Water Infrastructure Fund is created
21as a special fund in the State treasury. Subject to
22appropriation, moneys in the Fund shall be used by the

1Environmental Protection Agency to make grants to
2municipalities to fund infrastructure improvements to
3facilitate water supplies from Lake Michigan for residents of
4Cook County.
5    Notwithstanding any other provision of law, the Cook
6County Water Infrastructure Fund is not subject to sweeps,
7administrative charges or chargebacks, or any other fiscal or
8budgetary maneuver that would in any way transfer any funds
9from the Cook County Water Infrastructure Fund into any other
10fund of the State.
11    (c) In making grants from the Cook County Water
12Infrastructure Fund, the Agency must prioritize water
13infrastructure projects in non-supplying municipalities in
14Cook County over water infrastructure projects in supplying
15municipalities in Cook County.
16    (d) The Environmental Protection Agency may adopt rules
17under the Illinois Administrative Procedure Act to implement
18this Section.
 
19    Section 99. Effective date. This Act takes effect upon
20becoming law.
