SYNOPSIS AS INTRODUCED:
 
15 ILCS 205/4f new
55 ILCS 5/5-1186 new

    Amends the Counties Code. Provides that, if a majority of the county board, by resolution, declares there to be a conflict of interest between the State's Attorney and the county board, the county board may, for civil matters involving the county board, notify the Attorney General, or hire outside legal counsel, to represent the county board while the conflict of interest remains. Amends the Attorney General Act. Provides that, when notified by a county board that the county board has declared a conflict of interest between the State's Attorney and the county board, the Attorney General, or his or her designee, shall appear for and represent the county board in civil matters involving the county board until such time that the county board notifies the Attorney General that the conflict of interest no longer remains. Effective immediately.

1    AN ACT concerning local government.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 5. The Attorney General Act is amended by adding
5Section 4f as follows:
 
6    (15 ILCS 205/4f new)
7    Sec. 4f. Representation of county boards. When notified by
8a county board that the county board has declared a conflict of
9interest between the State's Attorney and the county board
10under Section 5-1186 of the Counties Code, the Attorney
11General, or his or her designee, shall appear for and
12represent the county board in civil matters involving the
13county board until such time that the county board notifies
14the Attorney General that the conflict of interest no longer
15remains.
 
16    Section 10. The Counties Code is amended by adding Section
175-1186 as follows:
 
18    (55 ILCS 5/5-1186 new)
19    Sec. 5-1186. Conflict of interest with State's Attorney.
