SYNOPSIS AS INTRODUCED:
 
55 ILCS 5/5-15003  from Ch. 34, par. 5-15003

    Amends the Counties Code. Provides that a superintendent of a department of public works shall be a registered professional engineer, hold a degree in engineering from an accredited institution of higher learning, or have at least 10 years of professional, management-level experience in either a municipal or county public works department (rather than the superintendent shall be a registered professional engineer). Effective immediately.

1    AN ACT concerning local government.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 5. The Counties Code is amended by changing
5Section 5-15003 as follows:
 
6    (55 ILCS 5/5-15003)  (from Ch. 34, par. 5-15003)
7    Sec. 5-15003. Department of public works. The county board
8may establish a department of public works with authority to
9exercise complete supervision in such county over any of the
10projects authorized by this Division in either of the methods
11designated hereafter.
12    A. The county board may employ a superintendent of public
13works and such other employees for the administration of the
14department as may be necessary. The superintendent shall be a
15registered professional engineer, hold a degree in engineering
16from an accredited institution of higher learning, or have at
17least 10 years of professional, management-level experience in
18either a municipal or county public works department. The
19superintendent and shall have complete authority to supervise
20and manage the department; or
21    B. Each county public works department shall be managed by
22a board of public works, consisting of 5 members appointed by
23the President and Chairman of the county board, with the

1approval of the county board, for a 3 year term, except that of
2the first appointees, 2 shall serve for one year, 2 for 2
3years, and one for 3 years. The term of office of original
4appointees shall be regarded as beginning on July 1, following
5their appointment, and the term of all members shall continue
6until their successors are appointed. At least 2 members must
7be elected officials of municipalities within the county whose
8terms of office within the municipalities will not expire
9prior to the termination of appointment hereunder, one member
10must be a member of the county board whose term of office will
11not expire prior to the termination of appointment hereunder,
12one member must be a trustee of a Sanitary District within the
13county whose term of office will not expire prior to the
14termination of appointment hereunder, and one member must be
15chosen to represent the Conservation and Public Health
16interests. The members of the board shall receive compensation
17as provided by the county board. The board of public works may
18employ a superintendent of public works and any other
19employees for the administration of the department as may be
20necessary. The superintendent must be a registered
21professional engineer, hold a degree in engineering from an
22accredited institution of higher learning, or have at least 10
23years of professional, management-level experience in either a
24municipal or county public works department. Any county may
25advance general funds for necessary studies or engineering for
26a project to be financed by revenue bonds and be reimbursed by

1the proceeds of such bonds. Any county may purchase such bonds
2with funds derived solely from the County Retailers Occupation
3Tax.
