| 2 | | AMENDMENT NO. ______. Amend House Bill 363 by replacing | 3 | | everything after the enacting clause with the following:

The Employment of Illinois Workers on Public | 5 | | Works Act is amended by changing Section 1 and by adding | 6 | | Section 3.1 as follows: | 7 | | (30 ILCS 570/1) (from Ch. 48, par. 2201) | 8 | | Sec. 1. Definitions. For the purposes of this Act, the | 9 | | following words have
the meanings ascribed to them in this | 10 | | Section. | 11 | | (1) "Illinois laborer" refers to any person who has | 12 | | resided in Illinois
for at least 30 days and intends to become | 13 | | or remain an Illinois resident. | 14 | | (2) "A period of excessive unemployment" means any month | 15 | | immediately
following 2 consecutive calendar months during | 16 | | which the level of unemployment
in the State of Illinois has |

Bureau of Labor | 2 | | Statistics in its monthly publication of employment and
| 3 | | unemployment figures. | 4 | | (3) "Hazardous waste" has the definition ascribed to it in | 5 | | Section 3.220 of
the Illinois Environmental Protection Act, | 6 | | approved June 29, 1970,
as amended. | 7 | | (4) "Interested party" means a person or entity with an | 8 | | interest in compliance with this Act. | 9 | | (5) "Entity" means any sole proprietor, partnership, firm, | 10 | | corporation, limited liability company, association, or other | 11 | | business enterprise; however, the term "entity" does not | 12 | | include (i) the State of Illinois or its officers, agencies, | 13 | | or political subdivisions or (ii) the federal government. | 14 | | (6) "Public works" means any fixed work construction or | 15 | | improvement for the State of Illinois or any political | 16 | | subdivision of the State if that fixed work construction or | 17 | | improvement is funded or financed in whole or in part with | 18 | | State funds or funds administered by the State of Illinois. | 19 | | (7) "Adequate welding standards" means specifications, | 20 | | guidelines, tests, and other methods used to ensure that all | 21 | | structural steel welds meet, at minimum, the codes and | 22 | | standards for such welds established in the welding code. | 23 | | (8) "Certified welding inspector" means a person who is | 24 | | certified by the American Welding Society to inspect | 25 | | structural steel welding projects and conduct welder | 26 | | qualification tests. |

| 1 | | (9) "Structural steel welding" means structural welds, | 2 | | weld repair, the structural system, and the welding of all | 3 | | primary steel members of a structure in accordance with the | 4 | | welding code. The term does not include welding that is | 5 | | required by the American Society of Mechanical Engineers to | 6 | | have its own certification. | 7 | | (10) "Welding code" means the American Welding Society | 8 | | structural steel welding code D1.1, as in effect on July 1, | 9 | | 2023. | 10 | | (11) "Department" means the Department of Labor. | 11 | | (Source: P.A. 96-929, eff. 6-16-10.) | 12 | | (30 ILCS 570/3.1 new) | 13 | | Sec. 3.1. Contractors. A contractor whose workers are | 14 | | welding the structural steel on a public works project shall | 15 | | ensure that all of the following occur: | 16 | | (1) the workers performing the structural steel | 17 | | welding have been tested by and hold a valid certification | 18 | | from a certified welding inspector; | 19 | | (2) the structural steel welding performed for the | 20 | | project meets adequate welding standards and is listed in | 21 | | the project's job specifications; and | 22 | | (3) the structural steel welding inspections listed in | 23 | | the project's job specifications are completed by a | 24 | | certified welding inspector. ".
