AMENDMENT TO HOUSE BILL 3093

2    AMENDMENT NO. ______. Amend House Bill 3093 by replacing
3everything after the enacting clause with the following:
 
4    "Section 5. The Equitable Restrooms Act is amended by
5changing Section 20 and by adding Section 30 as follows:
 
6    (410 ILCS 35/20)  (from Ch. 111 1/2, par. 3751-20)
7    Sec. 20. Application. Except for Section 25 and Section
830, this Act applies only to places of public accommodation
9that commence construction, or that commence alterations
10exceeding 50% of the entire place of public accommodation,
11after the effective date of this Act.

14    Sec. 30. Menstrual hygiene products in public restrooms.
15    (a) The General Assembly finds that:

1        (1) menstrual hygiene products are a health care
2    necessity and not an item that can be forgone or
3    substituted easily; and
4        (2) access to menstrual hygiene products is a serious
5    and ongoing need in this State.
6    (b) As used in this Section:
7    "Menstrual hygiene products" means tampons and sanitary
8napkins for use in connection with the menstrual cycle.
9    "Public restroom" means any public toilet facility that is
10available without preference to any specific gender or any
11public toilet facility that is available only to women.
12"Public restroom" does not include any public toilet facility
13in a mosque, temple, church, and other places of worship if the
14provision of menstrual hygiene products would conflict with
15the entity's sincerely held religious beliefs, practices, or
16observances.
17    (c) This Section applies to any existing or future public
18buildings, as that term is defined in Section 18.
19    (d) In a public restroom owned and operated by the State or
20any county, the State or applicable county shall make
21available and accessible in that public restroom menstrual
22hygiene products at no cost and shall be responsible for
23ordering, stocking, and replenishing the supply of those
24products in that restroom. This subsection does not apply to
25the Department of Natural Resources, which, subject to
26appropriation, may establish a pilot program to make menstrual

1hygiene products available, at no cost to the public, in each
2public restroom that is equipped with flush toilets and
3serviced daily at 5 State parks under the jurisdiction and
4control of the Department of Natural Resources.
 
5    Section 99. Effective date. This Act takes effect upon
6becoming law.".
