    Amends the Election Code. Provides that the State Board of Elections shall create a pilot program that allows petition signatures to be gathered electronically through a secure Internet portal. Provides that a statement of candidacy shall set out a telephone number and email address, if any, for a candidate. Provides that if a candidate seeks to run for countrywide office in Cook County, then the candidate's petition for nomination must contain at least 5,000 but not more than 10,000 signatures (rather than the number of signatures equal to 0.5% of the qualified electors of his or her party who casts votes at the last preceding general election in Cook County). Provides that a qualified primary elector of a party may sign petitions for a candidate in the primary of more than one party. Provides that each petition for nominations for mayor, city clerk, and city treasurer must be signed by at least 5,000 but not more than 10,000 legal voters of the city (rather than 12,500 legal voters of the city). Provides that no rule or ordinance shall be passed that prevents legal voters from signing petitions for nomination for 2 or more candidates running for the same office.

1    AN ACT concerning elections.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 5. The Election Code is amended by changing
5Sections 7-10, 8-8, and 10-5 and by adding Section 1a-61 as
6follows:
 
7    (10 ILCS 5/1a-61 new)
8    Sec. 1a-61. Pilot program for digital petition signatures.
9The State Board of Elections shall create a pilot program that
10allows petition signatures to be gathered electronically
11through a secure Internet portal. The system shall allow only
12those qualified electors who are eligible to sign a petition
13to do so and provide a way for the elector's identity to be
14verified.

16    Sec. 7-10. Form of petition for nomination. The name of no
17candidate for nomination, or State central committeeperson, or
18township committeeperson, or precinct committeeperson, or ward
19committeeperson or candidate for delegate or alternate

21upon the primary ballot unless a petition for nomination has

7    Each sheet of the petition other than the statement of
8candidacy and candidate's statement shall be of uniform size
9and shall contain above the space for signatures an
10appropriate heading giving the information as to name of
11candidate or candidates, in whose behalf such petition is
12signed; the office, the political party represented and place
13of residence; and the heading of each sheet shall be the same.
14    Such petition shall be signed by qualified primary
15electors residing in the political division for which the
16nomination is sought in their own proper persons only and
17opposite the signature of each signer, his residence address
18shall be written or printed. The residence address required to
19be written or printed opposite each qualified primary
20elector's name shall include the street address or rural route
21number of the signer, as the case may be, as well as the
22signer's county, and city, village or town, and state.
23However, the county or city, village or town, and state of
24residence of the electors may be printed on the petition forms
25where all of the electors signing the petition reside in the

1same county or city, village or town, and state. Standard
2abbreviations may be used in writing the residence address,
3including street number, if any. At the bottom of each sheet of
4such petition shall be added a circulator statement signed by
5a person 18 years of age or older who is a citizen of the
6United States, stating the street address or rural route
7number, as the case may be, as well as the county, city,
8village or town, and state; and certifying that the signatures
9on that sheet of the petition were signed in his or her
10presence and certifying that the signatures are genuine; and
11either (1) indicating the dates on which that sheet was
12circulated, or (2) indicating the first and last dates on
13which the sheet was circulated, or (3) for elections where the
14petition circulation period is 90 days, certifying that none
15of the signatures on the sheet were signed more than 90 days
16preceding the last day for the filing of the petition, or (4)
17for the 2022 general primary election only, certify that the
18signatures on the sheet were signed during the period of
19January 13, 2022 through March 14, 2022 or certify that the
20signatures on the sheet were signed during the period of
21January 13, 2022 through the date on which this statement was
22sworn or affirmed to and certifying that to the best of his or
23her knowledge and belief the persons so signing were at the
24time of signing the petitions qualified voters of the
25political party for which a nomination is sought. Such
26statement shall be sworn to before some officer authorized to

1administer oaths in this State.
2    Except as otherwise provided in this Code, no petition
3sheet shall be circulated more than 90 days preceding the last
4day provided in Section 7-12 for the filing of such petition.
5    The person circulating the petition, or the candidate on
6whose behalf the petition is circulated, may strike any
7signature from the petition, provided that:
8        (1) the person striking the signature shall initial
9    the petition at the place where the signature is struck;
10    and
11        (2) the person striking the signature shall sign a
12    certification listing the page number and line number of
13    each signature struck from the petition. Such
14    certification shall be filed as a part of the petition.
15    Such sheets before being filed shall be neatly fastened
16together in book form, by placing the sheets in a pile and
17fastening them together at one edge in a secure and suitable
18manner, and the sheets shall then be numbered consecutively.
19The sheets shall not be fastened by pasting them together end
20to end, so as to form a continuous strip or roll. All petition
21sheets which are filed with the proper local election
22officials, election authorities or the State Board of
23Elections shall be the original sheets which have been signed
24by the voters and by the circulator thereof, and not
25photocopies or duplicates of such sheets. Each petition must
26include as a part thereof, a statement of candidacy for each of

1the candidates filing, or in whose behalf the petition is
2filed. This statement shall set out the address of such
3candidate, a telephone number and email address, if any, for
4the candidate, the office for which he is a candidate, shall
5state that the candidate is a qualified primary voter of the
6party to which the petition relates and is qualified for the
7office specified (in the case of a candidate for State's
8Attorney it shall state that the candidate is at the time of
9filing such statement a licensed attorney-at-law of this
10State), shall state that he has filed (or will file before the
11close of the petition filing period) a statement of economic
12interests as required by the Illinois Governmental Ethics Act,
13shall request that the candidate's name be placed upon the
14official ballot, and shall be subscribed and sworn to by such
15candidate before some officer authorized to take
16acknowledgment of deeds in the State and shall be in
17substantially the following form:

1to, and no signatures shall be revoked except by revocation
2filed in writing with the State Board of Elections, election
3authority or local election official with whom the petition is
4required to be filed, and before the filing of such petition.
5Whoever forges the name of a signer upon any petition required
6by this Article is deemed guilty of a forgery and on conviction
7thereof shall be punished accordingly.
8    A candidate for the offices listed in this Section must
9obtain the number of signatures specified in this Section on
10his or her petition for nomination.
11    (a) Statewide office or delegate to a national nominating
12convention. Except as otherwise provided in this Code, if a
13candidate seeks to run for statewide office or as a delegate or
14alternate delegate to a national nominating convention elected
15from the State at-large, then the candidate's petition for
16nomination must contain at least 5,000 but not more than
1710,000 signatures.
18    (b) Congressional office or congressional delegate to a
19national nominating convention. Except as otherwise provided
20in this Code, if a candidate seeks to run for United States
21Congress or as a congressional delegate or alternate
22congressional delegate to a national nominating convention
23elected from a congressional district, then the candidate's
24petition for nomination must contain at least the number of
25signatures equal to 0.5% of the qualified primary electors of
26his or her party in his or her congressional district. In the

1first primary election following a redistricting of
2congressional districts, a candidate's petition for nomination
3must contain at least 600 signatures of qualified primary
4electors of the candidate's political party in his or her
5congressional district.
6    (c) County office. Except as otherwise provided in this
7Code, if a candidate seeks to run for any countywide office,
8including, but not limited to, county board chairperson or
9county board member, elected on an at-large basis, in a county
10other than Cook County, then the candidate's petition for
11nomination must contain at least the number of signatures
12equal to 0.5% of the qualified electors of his or her party who
13cast votes at the last preceding general election in his or her
14county. If a candidate seeks to run for county board member
15elected from a county board district, then the candidate's
16petition for nomination must contain at least the number of
17signatures equal to 0.5% of the qualified primary electors of
18his or her party in the county board district. In the first
19primary election following a redistricting of county board
20districts or the initial establishment of county board
21districts, a candidate's petition for nomination must contain
22at least the number of signatures equal to 0.5% of the
23qualified electors of his or her party in the entire county who
24cast votes at the last preceding general election divided by
25the total number of county board districts comprising the
26county board; provided that in no event shall the number of

1signatures be less than 25.
2    (d) County office; Cook County only.
3        (1) If a candidate seeks to run for countywide office
4    in Cook County, then the candidate's petition for
5    nomination must contain at least 5,000 but not more than
6    10,000 signatures the number of signatures equal to 0.5%
7    of the qualified electors of his or her party who cast
8    votes at the last preceding general election in Cook
9    County.
10        (2) If a candidate seeks to run for Cook County Board
11    Commissioner, then the candidate's petition for nomination
12    must contain at least the number of signatures equal to
13    0.5% of the qualified primary electors of his or her party
14    in his or her county board district. In the first primary
15    election following a redistricting of Cook County Board of
16    Commissioners districts, a candidate's petition for
17    nomination must contain at least the number of signatures
18    equal to 0.5% of the qualified electors of his or her party
19    in the entire county who cast votes at the last preceding
20    general election divided by the total number of county
21    board districts comprising the county board; provided that
22    in no event shall the number of signatures be less than 25.
23        (3) Except as otherwise provided in this Code, if a
24    candidate seeks to run for Cook County Board of Review
25    Commissioner, which is elected from a district pursuant to
26    subsection (c) of Section 5-5 of the Property Tax Code,

1    then the candidate's petition for nomination must contain
2    at least the number of signatures equal to 0.5% of the
3    total number of registered voters in his or her board of
4    review district in the last general election at which a
5    commissioner was regularly scheduled to be elected from
6    that board of review district. In no event shall the
7    number of signatures required be greater than the
8    requisite number for a candidate who seeks countywide
9    office in Cook County under subsection (d)(1) of this
10    Section. In the first primary election following a
11    redistricting of Cook County Board of Review districts, a
12    candidate's petition for nomination must contain at least
13    4,000 signatures or at least the number of signatures
14    required for a countywide candidate in Cook County,
15    whichever is less, of the qualified electors of his or her
16    party in the district.
17    (e) Municipal or township office. If a candidate seeks to
18run for municipal or township office, then the candidate's
19petition for nomination must contain at least the number of
20signatures equal to 0.5% of the qualified primary electors of
21his or her party in the municipality or township. If a
22candidate seeks to run for alderperson of a municipality, then
23the candidate's petition for nomination must contain at least
24the number of signatures equal to 0.5% of the qualified
25primary electors of his or her party of the ward. In the first
26primary election following redistricting of wards or trustee

1districts of a municipality or the initial establishment of
2wards or districts, a candidate's petition for nomination must
3contain the number of signatures equal to at least 0.5% of the
4total number of votes cast for the candidate of that political
5party who received the highest number of votes in the entire
6municipality at the last regular election at which an officer
7was regularly scheduled to be elected from the entire
8municipality, divided by the number of wards or districts. In
9no event shall the number of signatures be less than 25.
10    (f) State central committeeperson. If a candidate seeks to
11run for State central committeeperson, then the candidate's
12petition for nomination must contain at least 100 signatures
13of the primary electors of his or her party of his or her
14congressional district.
15    (g) Sanitary district trustee. Except as otherwise
16provided in this Code, if a candidate seeks to run for trustee
17of a sanitary district in which trustees are not elected from
18wards, then the candidate's petition for nomination must
19contain at least the number of signatures equal to 0.5% of the
20primary electors of his or her party from the sanitary
21district. If a candidate seeks to run for trustee of a sanitary
22district in which trustees are elected from wards, then the
23candidate's petition for nomination must contain at least the
24number of signatures equal to 0.5% of the primary electors of
25his or her party in the ward of that sanitary district. In the
26first primary election following redistricting of sanitary

1districts elected from wards, a candidate's petition for
2nomination must contain at least the signatures of 150
3qualified primary electors of his or her ward of that sanitary
4district.
5    (h) Judicial office. Except as otherwise provided in this
6Code, if a candidate seeks to run for judicial office in a
7district, then the candidate's petition for nomination must
8contain the number of signatures equal to 0.4% of the number of
9votes cast in that district for the candidate for his or her
10political party for the office of Governor at the last general
11election at which a Governor was elected, but in no event less
12than 500 signatures. If a candidate seeks to run for judicial
13office in a circuit or subcircuit, then the candidate's
14petition for nomination must contain the number of signatures
15equal to 0.25% of the number of votes cast for the judicial
16candidate of his or her political party who received the
17highest number of votes at the last general election at which a
18judicial officer from the same circuit or subcircuit was
19regularly scheduled to be elected, but in no event less than
201,000 signatures in circuits and subcircuits located in the
21First Judicial District or 500 signatures in every other
22Judicial District.
23    (i) Precinct, ward, and township committeeperson. Except
24as otherwise provided in this Code, if a candidate seeks to run
25for precinct committeeperson, then the candidate's petition
26for nomination must contain at least 10 signatures of the

1primary electors of his or her party for the precinct. If a
2candidate seeks to run for ward committeeperson, then the
3candidate's petition for nomination must contain no less than
4the number of signatures equal to 10% of the primary electors
5of his or her party of the ward, but no more than 16% of those
6same electors; provided that the maximum number of signatures
7may be 50 more than the minimum number, whichever is greater.
8If a candidate seeks to run for township committeeperson, then
9the candidate's petition for nomination must contain no less
10than the number of signatures equal to 5% of the primary
11electors of his or her party of the township, but no more than
128% of those same electors; provided that the maximum number of
13signatures may be 50 more than the minimum number, whichever
14is greater.
15    (j) State's attorney or regional superintendent of schools
16for multiple counties. If a candidate seeks to run for State's
17attorney or regional Superintendent of Schools who serves more
18than one county, then the candidate's petition for nomination
19must contain at least the number of signatures equal to 0.5% of
20the primary electors of his or her party in the territory
21comprising the counties.
22    (k) Any other office. If a candidate seeks any other
23office, then the candidate's petition for nomination must
24contain at least the number of signatures equal to 0.5% of the
25registered voters of the political subdivision, district, or
26division for which the nomination is made or 25 signatures,

1whichever is greater.
2    For purposes of this Section the number of primary
3electors shall be determined by taking the total vote cast, in
4the applicable district, for the candidate for that political
5party who received the highest number of votes, statewide, at
6the last general election in the State at which electors for
7President of the United States were elected. For political
8subdivisions, the number of primary electors shall be
9determined by taking the total vote cast for the candidate for
10that political party who received the highest number of votes
11in the political subdivision at the last regular election at
12which an officer was regularly scheduled to be elected from
13that subdivision. For wards or districts of political
14subdivisions, the number of primary electors shall be
15determined by taking the total vote cast for the candidate for
16that political party who received the highest number of votes
17in the ward or district at the last regular election at which
18an officer was regularly scheduled to be elected from that
19ward or district.
20    A "qualified primary elector" of a party may not sign
21petitions for or be a candidate in the primary of more than one
22party.
23    The changes made to this Section by Public Act 93-574 are
24declarative of existing law, except for item (3) of subsection
25(d).
26    Petitions of candidates for nomination for offices herein

1specified, to be filed with the same officer, may contain the
2names of 2 or more candidates of the same political party for
3the same or different offices. In the case of the offices of
4Governor and Lieutenant Governor, a joint petition including
5one candidate for each of those offices must be filed.

22    The receipt issued by the Secretary of State indicating
23that the candidate has filed the statement of economic
24interests required by the Illinois Governmental Ethics Act
25must be filed with the petitions for nomination as provided in
26subsection (8) of Section 7-12 of this Code.

1    Except as otherwise provided in this Code, all petitions
2for nomination for the office of State Senator shall be signed
3by at least 1,000 but not more than 3,000 of the qualified
4primary electors of the candidate's party in his legislative
5district.
6    Except as otherwise provided in this Code, all petitions
7for nomination for the office of Representative in the General
8Assembly shall be signed by at least 500 but not more than
91,500 of the qualified primary electors of the candidate's
10party in his or her representative district.
11    Opposite the signature of each qualified primary elector
12who signs a petition for nomination for the office of State
13Representative or State Senator such elector's residence
14address shall be written or printed. The residence address
15required to be written or printed opposite each qualified
16primary elector's name shall include the street address or
17rural route number of the signer, as the case may be, as well
18as the signer's county and city, village, or town.
19    For the purposes of this Section, the number of primary
20electors shall be determined by taking the total vote cast, in
21the applicable district, for the candidate for such political
22party who received the highest number of votes, state-wide, at
23the last general election in the State at which electors for
24President of the United States were elected.
25    A "qualified primary elector" of a party may not sign
26petitions for or be a candidate in the primary of more than one

1party.
2    In the affidavit at the bottom of each sheet, the petition
3circulator, who shall be a person 18 years of age or older who
4is a citizen of the United States, shall state his or her
5street address or rural route number, as the case may be, as
6well as his or her county, city, village or town, and state;
7and shall certify that the signatures on that sheet of the
8petition were signed in his or her presence; and shall certify
9that the signatures are genuine; and shall certify that, to
10the best of his or her knowledge and belief, the persons so
11signing were at the time of signing the petition qualified
12primary voters for which the nomination is sought.
13    In the affidavit at the bottom of each petition sheet, the
14petition circulator shall either (1) indicate the dates on
15which he or she circulated that sheet, or (2) indicate the
16first and last dates on which the sheet was circulated, or (3)
17for elections where the petition circulation period is 90
18days, certify that none of the signatures on the sheet were
19signed more than 90 days preceding the last day for the filing
20of the petition, or (4) for the 2022 general primary election
21only, certify that the signatures on the sheet were signed
22during the period of January 13, 2022 through March 14, 2022 or
23certify that the signatures on the sheet were signed during
24the period of January 13, 2022 through the date on which this
25statement was sworn or affirmed to. No petition sheet shall be
26circulated more than 90 days preceding the last day provided

1in Section 8-9 for the filing of such petition.
2    All petition sheets which are filed with the State Board
3of Elections shall be the original sheets which have been

9        (1) the person striking the signature shall initial
10    the petition at the place where the signature is struck;
11    and
12        (2) the person striking the signature shall sign a
13    certification listing the page number and line number of
14    each signature struck from the petition. Such
15    certification shall be filed as a part of the petition.

19    Sec. 10-5. All petitions for nomination shall, besides
20containing the names of candidates, specify as to each:
21    1. The office or offices to which such candidate or
22candidates shall be nominated.
23    2. The new political party, if any, represented, expressed
24in not more than 5 words. However, such party shall not bear

1political party as defined in this Article. This prohibition
2does not preclude any established political party from making
3nominations in those cases in which it is authorized to do so.
4    3. The place of residence of any such candidate or
5candidates with the street and number thereof, if any. In the
6case of electors for President and Vice-President of the
7United States, the names of candidates for President and
8Vice-President may be added to the party name or appellation.
9    Such certificate of nomination or nomination papers in
10addition shall include as a part thereof, the oath required by
11Section 7-10.1 of this Act and must include a statement of
12candidacy for each of the candidates named therein, except
13candidates for electors for President and Vice-President of
14the United States. Each such statement shall set out the
15address of such candidate, a telephone number and email
16address, if any, for the candidate, the office for which he is
17a candidate, shall state that the candidate is qualified for
18the office specified and has filed (or will file before the
19close of the petition filing period) a statement of economic
20interests as required by the Illinois Governmental Ethics Act,
21shall request that the candidate's name be placed upon the
22official ballot and shall be subscribed and sworn to by such
23candidate before some officer authorized to take
24acknowledgments of deeds in this State, and may be in
25substantially the following form:

1economic interests as required by the Illinois Governmental
2Ethics Act in relation to his candidacy with the appropriate
3officer by the end of the period for the filing of nomination
4papers unless he has filed a statement of economic interests
5in relation to the same governmental unit with that officer
6during the same calendar year as the year in which such
7nomination papers were filed. If the nomination papers of any
8candidate and the statement of economic interest of that
9candidate are not required to be filed with the same officer,
10the candidate must file with the officer with whom the
11nomination papers are filed a receipt from the officer with
12whom the statement of economic interests is filed showing the
13date on which such statement was filed. Such receipt shall be
14so filed not later than the last day on which nomination papers
15may be filed.

17    Section 10. The Revised Cities and Villages Act of 1941 is
18amended by changing Section 21-28 as follows:

20    Sec. 21-28. Nomination by petition.
21    (a) All nominations for alderperson of any ward in the
22city shall be by petition. Each petition for nomination of a
23candidate shall be signed by at least 473 legal voters of the
24ward.

1    (b) All nominations for mayor, city clerk, and city
2treasurer in the city shall be by petition. Each petition for
3nomination of a candidate must be signed by at least 5,000 but
4not more than 10,000 legal voters of the city 12,500 legal
5voters of the city.
6    (b-5) No rule or ordinance shall be passed that prevents
7legal voters from signing petitions for nomination for 2 or
8more candidates running for the same office.
9    (c) All such petitions, and procedure with respect
10thereto, shall conform in other respects to the provisions of
11the election and ballot laws then in force in the city of
12Chicago concerning the nomination of independent candidates
13for public office by petition. The method of nomination herein
14provided is exclusive of and replaces all other methods
15heretofore provided by law.
