Provides that the Adult Redeploy Illinois Oversight Board shall include 2 individuals who participated in Adult Redeploy Illinois-funded programs. Provides that the Adult Redeploy Illinois Oversight Board shall establish a grant program (rather than develop a formula) for the allotment of funds to local jurisdictions for local and community-based services in lieu of commitment to the Department of Corrections and a penalty amount for failure to reach the goal of reduced commitments stipulated in the plans. |

| 1 | | AN ACT concerning criminal law. | 2 | | Be it enacted by the People of the State of Illinois, | 3 | | represented in the General Assembly: | 4 | | Section 5. The Illinois Crime Reduction Act of 2009 is | 5 | | amended by changing Section 20 as follows: | 6 | | (730 ILCS 190/20) | 7 | | Sec. 20. Adult Redeploy Illinois. | 8 | | (a) Purpose. When offenders are accurately assessed for | 9 | | risk, assets, and needs, it is possible to identify which | 10 | | people should be sent to prison and which people can be | 11 | | effectively supervised in the locality. By providing financial | 12 | | incentives to counties or judicial circuits to create | 13 | | effective local-level evidence-based services, it is possible | 14 | | to reduce crime and recidivism at a lower cost to taxpayers. | 15 | | Based on this model, this Act hereby creates the Adult | 16 | | Redeploy Illinois program for probation-eligible offenders in | 17 | | order to increase public safety and encourage the successful | 18 | | local supervision of eligible offenders and their | 19 | | reintegration into the locality. | 20 | | (b) The Adult Redeploy Illinois program shall reallocate | 21 | | State funds to local jurisdictions that successfully establish | 22 | | a process to assess offenders and provide a continuum of | 23 | | locally based sanctions and treatment alternatives for |

| 1 | | offenders who would be incarcerated in a State facility if | 2 | | those local services and sanctions did not exist. The | 3 | | allotment of funds shall be based on a formula that rewards | 4 | | local jurisdictions for the establishment or expansion of | 5 | | local supervision programs and requires them to pay the amount | 6 | | determined in subsection (e) if incarceration targets as | 7 | | defined in subsection (e) are not met. | 8 | | (c) Each county or circuit participating in the Adult | 9 | | Redeploy Illinois program shall create a local plan describing | 10 | | how it will protect public safety and reduce the county or | 11 | | circuit's utilization of incarceration in State facilities or | 12 | | local county jails by the creation or expansion of | 13 | | individualized services or programs. | 14 | | (d) Based on the local plan, a county or circuit shall | 15 | | enter into an agreement with the Adult Redeploy Oversight | 16 | | Board described in subsection (e) to reduce the number of | 17 | | commitments of probation-eligible offenders to State | 18 | | correctional facilities from that county or circuit. The | 19 | | agreement shall include a pledge from the county or circuit to | 20 | | reduce their commitments by 25% of the level of commitments | 21 | | from the average number of commitments for the past 3 years of | 22 | | eligible offenders. In return, the county or circuit shall | 23 | | receive, based upon a formula described in subsection (e), | 24 | | funds to redeploy for local programming for offenders who | 25 | | would otherwise be incarcerated such as management and | 26 | | supervision, electronic monitoring, and drug testing. | 1 | | county or circuit shall also be penalized, as described in | 2 | | subsection (e), for failure to reach the goal of reduced | 3 | | commitments stipulated in the agreement. | 4 | | (d-5) Subject to appropriation to the Illinois Criminal | 5 | | Justice Information Authority, the Adult Redeploy Illinois | 6 | | Oversight Board described in subsection (e) may provide grant | 7 | | funds to qualified organizations that can assist local | 8 | | jurisdictions in training, development, and technical | 9 | | assistance. | 10 | | (e) Adult Redeploy Illinois Oversight Board; members; | 11 | | responsibilities. | 12 | | (1) The Secretary of Human Services and the Director | 13 | | of Corrections shall within 3 months after January 1, 2010 | 14 | | (the effective date of Public Act 96-761) convene and act | 15 | | as co-chairs of an oversight board to oversee the Adult | 16 | | Redeploy Program. The Board shall include, but not be | 17 | | limited to, designees from the Prisoner Review Board, | 18 | | Office of the Attorney General, Illinois Criminal Justice | 19 | | Information Authority, and Sentencing Policy Advisory | 20 | | Council; the Cook County State's Attorney or a designee; a | 21 | | State's Attorney selected by the President of the Illinois | 22 | | State's Attorneys Association; the State Appellate | 23 | | Defender or a designee; the Cook County Public Defender or | 24 | | a designee; a representative of Cook County Adult | 25 | | Probation, a representative of DuPage County Adult | 26 | | Probation; a representative of Sangamon County Adult |

| 1 | | Probation; and 4 representatives from non-governmental | 2 | | organizations, including service providers ; and 2 | 3 | | individuals who participated in Adult Redeploy | 4 | | Illinois-funded programs . Members shall serve without | 5 | | compensation but shall be reimbursed for actual expenses | 6 | | incurred in the performance of their duties. | 7 | | (2) The Oversight Board shall within one year after | 8 | | January 1, 2010 (the effective date of Public Act 96-761): | 9 | | (A) Develop a process to solicit applications from | 10 | | and identify jurisdictions to be included in the Adult | 11 | | Redeploy Illinois program. | 12 | | (B) Define categories of membership for local | 13 | | entities to participate in the creation and oversight | 14 | | of the local Adult Redeploy Illinois program. | 15 | | (C) Establish a grant program Develop a formula | 16 | | for the allotment of funds to local jurisdictions for | 17 | | local and community-based services in lieu of | 18 | | commitment to the Department of Corrections and a | 19 | | penalty amount for failure to reach the goal of | 20 | | reduced commitments stipulated in the plans. | 21 | | (D) Develop a standard format for the local plan | 22 | | to be submitted by the local entity created in each | 23 | | county or circuit. | 24 | | (E) Identify and secure resources sufficient to | 25 | | support the administration and evaluation of Adult | 26 | | Redeploy Illinois. |

| 1 | | (F) Develop a process to support ongoing | 2 | | monitoring and evaluation of Adult Redeploy Illinois. | 3 | | (G) Review local plans and proposed agreements and | 4 | | approve the distribution of resources. | 5 | | (H) Develop a performance measurement system that | 6 | | includes but is not limited to the following key | 7 | | performance indicators: recidivism, rate of | 8 | | revocations, employment rates, education achievement, | 9 | | successful completion of substance abuse treatment | 10 | | programs, and payment of victim restitution. Each | 11 | | county or circuit shall include the performance | 12 | | measurement system in its local plan and provide data | 13 | | annually to evaluate its success. | 14 | | (I) Report annually the results of the performance | 15 | | measurements on a timely basis to the Governor and | 16 | | General Assembly. | 17 | | (3) The Oversight Board shall: | 18 | | (A) Develop a process to solicit grant | 19 | | applications from eligible training, development, and | 20 | | technical assistance organizations. | 21 | | (B) Review grant applications and proposed grant | 22 | | agreements and approve the distribution of resources. | 23 | | (C) Develop a process to support ongoing | 24 | | monitoring of training, development, and technical | 25 | | assistance grantees. | 26 | | (Source: P.A. 103-8, eff. 6-7-23.) |
