AMENDMENT TO HOUSE BILL 4488

2    AMENDMENT NO. ______. Amend House Bill 4488, AS AMENDED,
3with reference to page and line numbers of Senate Amendment
4No. 2, on page 14, line 22, by deleting "10-1,"; and
 
5by deleting line 19 on page 65 through line 6 on page 68; and
 
6on page 70, line 4, by replacing "113" with "141 113"; and
 
7on page 102, immediately below line 19, by inserting the
8following:
 
9    "Section 10-27. The Fox Waterway Agency Act is amended by
10changing Section 5 as follows:
 
11    (615 ILCS 90/5)  (from Ch. 19, par. 1205)
12    Sec. 5. The Agency shall be governed by a Board of
13Directors, which shall consist of 6 directors and one chairman

1elected pursuant to this Section.
2    Three directors shall be elected from within the territory
3of each member county. Any resident of a member county and the
4territory of the Agency, at least 18 years of age, may become a
5candidate for election as a director by filing a nominating
6petition with the State Board of Elections containing the
7verified signatures of at least 200 of the registered voters
8of such county who reside within the territory of the Agency.
9Such petition shall be filed not more than 141 113 nor less
10than 134 106 days prior to the date of election.
11    The chairman shall be elected at large from the territory
12of the Agency. Any person eligible to become a candidate for
13election as director may become a candidate for election as
14chairman by filing a nominating petition with the State Board
15of Elections containing the verified signatures of at least
16200 of the registered voters of each member county who reside
17within the territory of the Agency. Such petition shall be
18filed not more than 141 113 nor less than 134 106 days prior to
19the date of the election.
20    Within 7 days after each consolidated election at which
21the chairman is elected, the county clerk of each member
22county shall transmit the returns for the election to the
23office of chairman to the State Board of Elections. The State
24Board of Elections shall immediately canvass the returns and
25proclaim the results thereof and shall issue a certificate of
26election to the person so elected.

1    Beginning in 1985, the directors and chairman shall be
2elected at the consolidated election and shall serve from the
3third Monday in May following their respective elections until
4their respective successors are elected and qualified. The
5term of office of a director shall be for 4 years, except that
6of the directors elected at the consolidated election of 1985,
73 shall serve until the first Monday in May 1987 and 3 shall
8serve until the first Monday in May 1989. The term of office of
9a chairman shall be 4 years.
10    At least 90 days before the consolidated election of 1985
11the State Board of Elections shall meet to determine by lot
12which 3 director positions shall be elected for terms to
13expire on the first Monday in May 1987 and which 3 director
14positions shall be elected for terms to expire on the first
15Monday in May 1989. At least one director position from each
16member county shall be elected for a term to expire on the
17first Monday in May 1987.
18    The county clerks of the member counties shall provide
19notice of each election for chairman and director in the
20manner prescribed in Article 12 of The Election Code, with the
21notice of the elections to be held at the consolidated
22election of 1985 to include a statement as to whether the
23director is to be elected for a term of 2 years or for a term
24of 4 years.
25    A chairman shall be elected at the consolidated election
26of 1985 and at each consolidated election every 4 years

1thereafter. Six directors shall be elected at the consolidated
2election of 1985. At the consolidated election of 1987, and at
3each consolidated election every 4 years thereafter, directors
4shall be elected from the constituencies of the directors who
5were elected at the consolidated election of 1985 and whose
6terms expired on the first Monday in May 1987. At the
7consolidated election of 1989, and at each consolidated
8election every 4 years thereafter, directors shall be elected
9from the constituencies of the directors who were elected at
10the consolidated election of 1985 and whose terms expired on
11the first Monday in May 1989.
12    Vacancies in the office of director or chairman shall be
13filled by the remaining members of the Board, who shall
14appoint to fill the vacated office for the remainder of the
15term of such office an individual who would be eligible for
16election to such office. If, however, a vacancy occurs in the
17office of chairman or director with at least 28 months
18remaining in the term of such office, the office shall be
19filled for the remainder of the term at the next consolidated
20election. Until the office is filled by election, the
21remaining members of the Board shall appoint a qualified
22person to the office in the manner provided in this Section.
