SYNOPSIS AS INTRODUCED:

735 ILCS 5/21-106 new

Amends the Code of Civil Procedure. Creates a process that Illinois residents may use to seek an Illinois judicial order making findings of fact to change a government-issued document from another state or country so that they may petition the issuing jurisdiction to change such a document.

A BILL FOR

AN ACT concerning civil law.

Be it enacted by the People of the State of Illinois, represented in the General Assembly:

Section 5. The Code of Civil Procedure is amended by adding Section 21-106 as follows:

Sec. 21-106. Legislative intent. Residents of this State who were born in another state or in another country may have difficulty in securing government-issued documents with the correct information. It is the intent of the General Assembly that Illinois should have a legal process available for these residents to seek a judicial order making findings of fact so that they may petition the issuing jurisdiction to change such a document.

(a) Process. An Illinois resident may file a petition in his or her county of residence asking for a court to issue a finding of fact or facts to correct or update a government-issued document from another state or country. As used in this Section, "government-issued document" includes, but is not limited to, birth certificate, passport, driver's license, or identification card.

(b) The petition must contain the following information:

(1) petitioner's name and current address;

(2) the government-issued document that is at issue;

(3) the change that is sought;

(4) the reason for the change; and

(5) any person or entity that should receive notice of this petition, if any.

(c) The court must schedule a hearing for this request and may, depending on the facts alleged in the petition, order notice of the hearing to a person or entity.
