| Amends various Acts relating to the governance of public universities in Illinois. Makes changes to the provisions concerning the in-state tuition charge to require that, for tuition purposes beginning with the 2025-2026 academic year, the governing board of each public university, at a minimum, deem an individual, other than an excluded nonimmigrant alien, an Illinois resident, until the individual establishes a residence outside of this State, if the individual (1) attended a specified institution located in this State; (2) graduated from a high school or received the equivalent of a high school diploma in this State, attained an associate degree from a public community college, or completed a General Education Core Curriculum package under the Illinois Articulation Initiative Act for students transferring from a public community college; (3) is a current student of or is registering as an entering student in the university; and (4) attests, if the individual is not a citizen or a lawful permanent resident of the United States, that the individual will file an application to become a permanent resident of the United States at the earliest opportunity. |

| 1 | | AN ACT concerning education. | 2 | | Be it enacted by the People of the State of Illinois, | 3 | | represented in the General Assembly: | 4 | | Section 5. The University of Illinois Act is amended by | 5 | | changing Section 7e-5 as follows: | 6 | | (110 ILCS 305/7e-5) | 7 | | Sec. 7e-5. In-state tuition charge. | 8 | | (a) Notwithstanding any other provision of law to the | 9 | | contrary, for tuition purposes through the 2024-2025 academic | 10 | | year , the Board of Trustees shall deem an individual an | 11 | | Illinois resident, until the individual establishes a | 12 | | residence outside of this State, if all of the following | 13 | | conditions are met: | 14 | | (1) The individual resided with his or her parent or | 15 | | guardian while attending a public or private high school | 16 | | in this State. | 17 | | (2) The individual graduated from a public or private | 18 | | high school or received the equivalent of a high school | 19 | | diploma in this State. | 20 | | (3) The individual attended school in this State for | 21 | | at least 3 years as of the date the individual graduated | 22 | | from high school or received the equivalent of a high | 23 | | school diploma. |

Beginning with the 2009-2010 academic year, | 10 | | if a person is on active military duty and is stationed out of | 11 | | State, but he or she was stationed in this State for at least 3 | 12 | | years immediately prior to being reassigned out of State, then | 13 | | the Board of Trustees shall deem that person and any of his or | 14 | | her dependents Illinois residents for tuition purposes, as | 15 | | long as that person or his or her dependent (i) applies for | 16 | | admission to the University within 18 months of the person on | 17 | | active military duty being reassigned or (ii) remains | 18 | | continuously enrolled at the University. Beginning with the | 19 | | 2013-2014 academic year, if a person is utilizing benefits | 20 | | under the federal Post-9/11 Veterans Educational Assistance | 21 | | Act of 2008 or any subsequent variation of that Act, then the | 22 | | Board of Trustees shall deem that person an Illinois resident | 23 | | for tuition purposes. Beginning with the 2015-2016 academic | 24 | | year, if a person is utilizing benefits under the federal | 25 | | All-Volunteer Force Educational Assistance Program, then the | 26 | | Board of Trustees shall deem that person an Illinois resident |

Beginning with the 2019-2020 academic | 2 | | year, per the federal requirements for maintaining approval | 3 | | for veterans' education benefits under 38 U.S.C. 3679(c), if a | 4 | | person is on active military duty or is receiving veterans' | 5 | | education benefits, then the Board of Trustees shall deem that | 6 | | person an Illinois resident for tuition purposes for any | 7 | | academic quarter, semester, or term, as applicable. | 8 | | (Source: P.A. 101-424, eff. 8-16-19.) | 9 | | Section 10. In-state tuition charge. | 5 | | (a) Notwithstanding any other provision of law to the | 6 | | contrary, for tuition purposes through the 2024-2025 academic | 7 | | year , the Board shall deem an individual an Illinois resident, | 8 | | until the individual establishes a residence outside of this | 9 | | State, if all of the following conditions are met: | 10 | | (1) The individual resided with his or her parent or | 11 | | guardian while attending a public or private high school | 12 | | in this State. | 13 | | (2) The individual graduated from a public or private | 14 | | high school or received the equivalent of a high school | 15 | | diploma in this State. | 16 | | (3) The individual attended school in this State for | 17 | | at least 3 years as of the date the individual graduated | 18 | | from high school or received the equivalent of a high | 19 | | school diploma. | 20 | | (4) The individual registers as an entering student in | 21 | | the University not earlier than the 2003 fall semester. | 22 | | (5) In the case of an individual who is not a citizen | 23 | | or a permanent resident of the United States, the | 24 | | individual provides the University with an affidavit |

| 1 | | stating that the individual will file an application to | 2 | | become a permanent resident of the United States at the | 3 | | earliest opportunity the individual is eligible to do so. | 4 | | This subsection (a) applies only to tuition for a term or | 5 | | semester that begins on or after May 20, 2003 (the effective | 6 | | date of Public Act 93-7) but before the 2025-2026 academic | 7 | | year . | 1 | | (b) If a person is on active military duty and stationed in | 2 | | Illinois, then the Board shall deem that person and any of his | 3 | | or her dependents Illinois residents for tuition purposes. | 4 | | Beginning with the 2009-2010 academic year, if a person is on | 5 | | active military duty and is stationed out of State, but he or | 6 | | she was stationed in this State for at least 3 years | 7 | | immediately prior to being reassigned out of State, then the | 8 | | Board shall deem that person and any of his or her dependents | 9 | | Illinois residents for tuition purposes, as long as that | 10 | | person or his or her dependent (i) applies for admission to the | 11 | | University within 18 months of the person on active military | 12 | | duty being reassigned or (ii) remains continuously enrolled at | 13 | | the University. Beginning with the 2013-2014 academic year, if | 14 | | a person is utilizing benefits under the federal Post-9/11 | 15 | | Veterans Educational Assistance Act of 2008 or any subsequent | 16 | | variation of that Act, then the Board shall deem that person an | 17 | | Illinois resident for tuition purposes. Beginning with the | 18 | | 2015-2016 academic year, if a person is utilizing benefits | 19 | | under the federal All-Volunteer Force Educational Assistance | 20 | | Program, then the Board shall deem that person an Illinois | 21 | | resident for tuition purposes. Beginning with the 2019-2020 | 22 | | academic year, per the federal requirements for maintaining | 23 | | approval for veterans' education benefits under 38 U.S.C. | 24 | | 3679(c), if a person is on active military duty or is receiving | 25 | | veterans' education benefits, then the Board of Trustees shall | 26 | | deem that person an Illinois resident for tuition purposes for |
