| 2 | | AMENDMENT NO. ______. Amend Senate Bill 58 by replacing | 3 | | everything after the enacting clause with the following:
| 4 | | "Section 1. Short title. This Act may be cited as the State | 5 | | Entities Single-Use Plastic Reporting Act. | 6 | | Section 5. Definitions. As used in this Act: | 7 | | "Single-use plastic disposable foodware" means containers, | 8 | | bowls, straws, plates, trays, cartons, cups, lids, forks, | 9 | | spoons, knives, and other items that are designed for one-time | 10 | | use for beverages, prepared food, or leftovers from meals and | 11 | | that are made of plastic, are not compostable, and are not | 12 | | accepted in residential curbside recycling pick up. | 13 | | "State agency" means any department, commission, council,
| 14 | | board, bureau, committee, institution, agency, university,
| 15 | | government corporation, authority, or other establishment or
| 16 | | official of this State. "State agency" includes any

| 1 | | establishment or official of the State that directly or
| 2 | | indirectly oversees the State's purchase of any product for
| 3 | | use in the State. | 4 | | Section 10. State agencies tracking single-use plastic | 5 | | disposable foodware. | 6 | | (a) Beginning July 1, 2024, each State agency shall: | 7 | | (1) track its own purchases of single-use plastic | 8 | | disposable foodware that are less than $2,000 or otherwise | 9 | | not reduced to writing; and | 10 | | (2) establish goals on reducing single-use plastic | 11 | | disposable foodware purchases based on the tracked | 12 | | purchases. | 13 | | (b) Each State agency shall submit a report of its | 14 | | findings regarding the matters in subsection (a) to the | 15 | | Governor and the General Assembly on or before October 1, | 16 | | 2025.
| 17 | | Section 90. Repealer. This Act is repealed on October 1, | 18 | | 2026. | 19 | | Section 900. The Department of Employment Security Law of | 20 | | the
Civil Administrative Code of Illinois is amended by adding | 21 | | Section 1005-170 as follows: | 22 | | (20 ILCS 1005/1005-170 new) |

| 1 | | Sec. 1005-170. Polystyrene job study. | 2 | | (a) The Department shall conduct a study on the potential | 3 | | impact on the State's workforce of legislation prohibiting the | 4 | | sale and distribution of disposable food service containers | 5 | | composed in whole or in part of polystyrene foam. The | 6 | | Department shall include in the study, at minimum: | 7 | | (1) data related to employment in the State of | 8 | | individuals who are engaged in the manufacture of | 9 | | polystyrene foam; | 10 | | (2) data concerning potential worker displacement that | 11 | | would result from prohibiting the sale or distribution in | 12 | | the State of disposable food service containers composed | 13 | | in whole or in part of polystyrene foam; | 14 | | (3) data concerning the potential for the | 15 | | transitioning of jobs related to the manufacture of | 16 | | polystyrene foam products to similar or other jobs; and | 17 | | (4) recommendations for worker protections and the | 18 | | minimization of job losses arising from the prohibition on | 19 | | the sale or distribution in the State of disposable food | 20 | | service containers composed in whole or in part of | 21 | | polystyrene foam. | 22 | | (b) The Department shall submit the findings of the study | 23 | | in a report to the General Assembly and the Governor no later | 24 | | than December 1, 2023. | 25 | | (c) This Section is repealed on July 1, 2025. |

| 1 | | Section 905. The Illinois Procurement Code is amended by | 2 | | adding Section 45-24 as follows: | 3 | | (30 ILCS 500/45-24 new) | 4 | | Sec. 45-24. Single-use plastics prohibition; preference. | 5 | | (a) As used in this Section: | 6 | | "Compostable" means that the item meets the ASTM D6400 | 7 | | standard of compostability and has been certified by the | 8 | | Biodegradable Products Institute as compostable. | 9 | | "Compostable foodware" means containers, bowls, straws, | 10 | | plates, trays, cartons, cups, lids, forks, spoons, knives, and | 11 | | other items that are designed for one-time use for beverages, | 12 | | prepared food, or leftovers from meals that are compostable. | 13 | | "Disposable food service container" means serviceware | 14 | | designed for one-time use. "Disposable food service container" | 15 | | includes, but is not limited to, serviceware for take-out | 16 | | foods, bakery products, and leftovers from partially consumed | 17 | | meals. "Disposable food service container" does not include | 18 | | polystyrene foam coolers, egg carton containers, ice chests | 19 | | that are used for the processing or shipping of seafood or | 20 | | service ware that is used to contain, transport, or otherwise | 21 | | package raw, uncooked, or butchered meat, poultry, fish, or | 22 | | seafood. | 23 | | "Polystyrene foam" means blown polystyrene and expanded or | 24 | | extruded foams using a styrene monomer. | 25 | | "Recyclable foodware" means items that are designed for |

| 1 | | one-time use for beverages, prepared food, or leftovers from | 2 | | meals and that are commonly accepted in local curbside | 3 | | residential recycling pick up. | 4 | | "Serviceware" means a container, bowl, plate, tray, | 5 | | carton, cup, lid, or other item designed to contain, | 6 | | transport, serve, or aid in the consumption of food or | 7 | | beverages. | 8 | | "State agency" has the meaning given to that term in | 9 | | Section 1-15.100 of this Code. | 10 | | (b) After January 1, 2025, State agencies and departments | 11 | | may not procure disposable food service containers that are | 12 | | composed in whole or in part from polystyrene foam for use at | 13 | | any State agency or department and instead shall offer only | 14 | | compostable foodware or recyclable foodware for use at the | 15 | | State agency or department. | 16 | | (c) After January 1, 2026, or at the renewal of its next | 17 | | contract, whichever occurs later, no vendor contracted through | 18 | | a State agency or department may provide customers with | 19 | | disposable food service containers that are composed in whole | 20 | | or in part from polystyrene foam and instead shall offer only | 21 | | compostable foodware or recyclable foodware.
| 22 | | Section 999. Effective date. This Act takes effect upon | 23 | | becoming law.".
