| 2 | | AMENDMENT NO. ______. Amend Senate Bill 58, AS AMENDED, by | 3 | | replacing everything after the enacting clause with the | 4 | | following:
| 5 | | "Section 1. Short title. This Act may be cited as the State | 6 | | Entities Single-Use Plastic Reporting Act. | 7 | | Section 5. Definitions. As used in this Act: | 8 | | "Single-use plastic disposable foodware" means containers, | 9 | | bowls, straws, plates, trays, cartons, cups, lids, forks, | 10 | | spoons, knives, and other items that are designed for one-time | 11 | | use for beverages, prepared food, or leftovers from meals and | 12 | | that are made of plastic, are not compostable, and are not | 13 | | accepted in residential curbside recycling pick up. | 14 | | "State agency" means any department, commission, council,
| 15 | | board, bureau, committee, institution, agency, university,
| 16 | | government corporation, authority, or other establishment or

| 1 | | official of this State. "State agency" includes any
| 2 | | establishment or official of the State that directly or
| 3 | | indirectly oversees the State's purchase of any product for
| 4 | | use in the State. | 5 | | Section 10. State agencies tracking single-use plastic | 6 | | disposable foodware. | 7 | | (a) Beginning, July 1, 2024, each State agency shall: | 8 | | (1) track its own purchases of single-use plastic | 9 | | disposable foodware that are less than $2,000 or otherwise | 10 | | not reduced to writing; and | 11 | | (2) establish goals on reducing single-use plastic | 12 | | disposable foodware purchases based on the tracked | 13 | | purchases. | 14 | | (b) Each State agency shall submit a report of its | 15 | | findings regarding the matters in subsection (a) to the | 16 | | Governor and the General Assembly on or before October 1, | 17 | | 2025.
| 18 | | Section 90. Repealer. This Act is repealed on October 1, | 19 | | 2026.".
