AMENDMENT TO SENATE BILL 74

2    AMENDMENT NO. ______. Amend Senate Bill 74 by replacing
3everything after the enacting clause with the following:
 
4    "Section 5. The Illinois Housing Development Act is
5amended by adding Section 35 as follows:
 
6    (20 ILCS 3805/35 new)
7    Sec. 35. Property Tax Payment Plan Task Force.
8    (a) In counties with 3,000,000 or more inhabitants, the
9annual tax sale has a disproportionately negative impact on
10minority communities. The loss of owner-occupied homes as the
11result of the tax sale results in a loss of home equity for
12impacted households and negatively impacts their ability to
13build generational wealth. The creation of a well-designed
14payment plan program for owner-occupants to repay delinquent
15property taxes has the potential to help homeowners who cannot
16afford their property taxes avoid the tax sale and potential

1loss of their home, while also ensuring that property taxes
2are collected for the benefit of local taxing districts,
3contributing to a more equitable and effective property tax
4system.
5    (b) The Property Tax Payment Plan Task Force is hereby
6created. The Task Force shall consist of the following
7members:
8        (1) one co-chairperson appointed by the President of
9    the Senate;
10        (2) one co-chairperson appointed by the Speaker of the
11    House of Representatives;
12        (3) one member appointed by the executive director of
13    the Illinois Housing Development Authority;
14        (4) one member representing the Cook County
15    Treasurer's Office, appointed by the Governor;
16        (5) one member representing the Cook County Clerk's
17    office, appointed by the Governor;
18        (5) one member representing the Cook County
19    President's Office, appointed by the Governor;
20        (6) up to 2 members, appointed by the Governor,
21    representing nonprofit affordable housing organizations in
22    counties with 3,000,000 or more inhabitants, housing
23    counseling organizations in counties with 3,000,000 or
24    more inhabitants, or homeownership organizations in
25    counties with 3,000,000 or more inhabitants;
26        (7) up to 2 members, appointed by the Governor,

1    representing community, neighborhood, or resident
2    associations in counties with 3,000,000 or more
3    inhabitants;
4        (8) up to 2 members, appointed by the Governor,
5    representing public interest organizations from counties
6    with 3,000,000 or more inhabitants or civic organizations
7    from counties with 3,000,000 or more inhabitants;
8        (9) up to 3 members, appointed by the Governor,
9    representing local municipalities with properties that are
10    the most highly represented in the annual tax sale in
11    counties with 3,000,000 or more inhabitants; and
12        (10) up to 3 members, appointed by the Governor,
13    representing taxing districts, other than municipalities,
14    with properties that are the most highly represented in
15    the annual tax sale in counties with 3,000,000 or more
16    inhabitants.
17    Members of the Task Force shall be appointed no later than
1830 days after the effective date of this amendatory Act of the
19103rd General Assembly. If any members are not appointed
20within that 30-day period, the appointing authority shall be
21deemed to have waived the right to make that appointment.
22Vacancies in the Task Force, other than a vacancy occurring
23because of a waiver by the appointing authority under this
24subsection, shall be filled by the original appointing
25authority.
26    (c) Members of the Task Force shall serve without

1compensation. The Illinois Housing Development Authority shall
2provide administrative support to the Task Force as needed.
3    (d) The members of the Task Force are exempt from any
4training, disclosure, or filing requirements under the State
5Officials and Employees Ethics Act, the Illinois Governmental
6Ethics Act, or any other applicable State law or rule imposing
7such requirements.
8    (e) Once all of the members have been appointed, the Task
9Force shall meet not less than 4 times to carry out the duties
10prescribed in this Section. Members of the Task Force may
11attend those meetings virtually.
12    (f) The Task Force shall study and make recommendations
13for the implementation of one or more payment plan options in
14counties with 3,000,000 or more inhabitants to prevent
15eligible tax-delinquent owner-occupied properties in those
16counties from being sold at the annual tax sale. The Task Force
17shall take into consideration the impact of the payment plan
18option on homeowners, taxpayers, local agencies responsible
19for the collection of property taxes, and local taxing
20districts. These recommendations may be used to recommend
21legislation in a future General Assembly.
22    (g) A report detailing the Task Force's findings,
23conclusions, and recommendations shall be submitted to the
24General Assembly no later than November 15, 2023. The Task
25Force is dissolved upon submission of the report.
26    (h) This Section is repealed on January 1, 2025.

1    Section 99. Effective date. This Act takes effect upon
2becoming law.".
