Amends the Illinois Vehicle Code. Deletes language providing that the school zone speed limit applies only when when school children are present and so close
thereto
that a potential hazard exists because of the close proximity of the motorized
traffic. For the purpose of provisions concerning the school zone speed limit, changes the time at which a school day concludes from 4 p.m. to 5 p.m.

| 2 | | Be it enacted by the People of the State of Illinois,
| 3 | | represented in the General Assembly:
| 4 | | Section 5. The Illinois Vehicle Code is amended by | 5 | | changing Section 11-605 as follows:
| 6 | | (625 ILCS 5/11-605) (from Ch. 95 1/2, par. 11-605)
| 7 | | Sec. 11-605. Special speed limit while passing schools.
| 8 | | (a) For the purpose of this Section, "school" means the | 9 | | following
entities:
| 10 | | (1) A public or private primary or secondary school.
| 11 | | (2) A primary or secondary school operated by a | 12 | | religious institution.
| 13 | | (3) A public, private, or religious nursery school.
| 14 | | On a school day when school children are present and so | 15 | | close
thereto
that a potential hazard exists because of the | 16 | | close proximity of the motorized
traffic , no person shall | 17 | | drive a motor vehicle at a speed in excess of 20 miles
per hour | 18 | | while passing a school zone or while traveling on a local, | 19 | | county, or State roadway on public
school property or upon any | 20 | | public
thoroughfare where children pass going
to and from | 21 | | school.
| 22 | | For the purpose of this Section, a school day begins at | 23 | | 6:30 a.m. and concludes at 5 4 p.m.

| 1 | | This Section shall not be applicable unless appropriate | 2 | | signs are posted
upon streets and highways under their | 3 | | respective jurisdiction and
maintained by the Department, | 4 | | township, county, park district, city,
village or incorporated | 5 | | town wherein the school zone is located. With regard
to the | 6 | | special speed limit while passing schools, such signs
shall | 7 | | give proper due warning that a school zone is being approached | 8 | | and
shall indicate the school zone and the maximum speed limit | 9 | | in effect during
school days when school children are present.
| 10 | | (b) (Blank).
| 11 | | (c) Nothing in this Chapter shall
prohibit the use of | 12 | | electronic speed-detecting devices within 500 feet of
signs | 13 | | within a special school speed zone indicating such zone, as | 14 | | defined
in this Section, nor shall evidence obtained thereby | 15 | | be inadmissible in any
prosecution for speeding provided the | 16 | | use of such device shall apply only
to the enforcement of the | 17 | | speed limit in such special school speed zone.
| 18 | | (d) (Blank).
| 19 | | (e) Except as provided in subsection (e-5), a person who | 20 | | violates this Section is guilty of a petty
offense. Violations | 21 | | of this Section are punishable with a minimum fine
of $150 for | 22 | | the first violation, a minimum fine of $300 for the second or | 23 | | subsequent violation, and community service in an amount | 24 | | determined by the court.
| 25 | | (e-5) A person committing a violation of this Section is | 26 | | guilty of aggravated special speed limit while passing schools |

| 1 | | when he or she drives a motor vehicle at a speed that is: | 2 | | (1) 26 miles per hour or more but less than 35 miles | 3 | | per hour in excess of the applicable special speed limit | 4 | | established under this Section or a similar provision of a | 5 | | local ordinance and is guilty of a Class B misdemeanor; or | 6 | | (2) 35 miles per hour or more in excess of the | 7 | | applicable special speed limit established under this | 8 | | Section or a similar provision of a local ordinance and is | 9 | | guilty of a Class A misdemeanor. | 10 | | (f) (Blank).
