AMENDMENT TO SENATE BILL 759

2    AMENDMENT NO. ______. Amend Senate Bill 759 by replacing
3everything after the enacting clause with the following:
 
4    "Section 5. The Podiatric Medical Practice Act of 1987 is
5amended by changing Section 5 and by adding Section 20.6 as
6follows:
 
7    (225 ILCS 100/5)  (from Ch. 111, par. 4805)
8    (Section scheduled to be repealed on January 1, 2028)
9    Sec. 5. Definitions. As used in this Act:
10    (A) "Department" means the Department of Financial and
11Professional Regulation.
12    (B) "Secretary" means the Secretary of Financial and
13Professional Regulation.
14    (C) "Board" means the Podiatric Medical Licensing Board
15appointed by the Secretary.
16    (D) "Podiatric medicine" or "podiatry" means:

1        (1) the diagnosis, medical, physical, or surgical
2    treatment of the ailments of the human foot, including
3    amputations as defined in this Section; .
4        (2) "Podiatric medicine" or "podiatry" includes the
5    provision of topical and local anesthesia and moderate and
6    deep sedation, as defined by Department rule adopted under
7    the Medical Practice Act of 1987; and
8        (3) vaccination of patients 18 years of age and older
9    in accordance with Section 20.6 upon completion of
10    appropriate training.
11        For the purposes of this Act, the terms podiatric
12    medicine, podiatry and chiropody have the same definition.
13    (E) "Human foot" means the ankle and soft tissue which
14insert into the foot as well as the foot.
15    (F) "Podiatric physician" means a physician licensed to
16practice podiatric medicine.
17    (G) "Postgraduate training" means a minimum one-year
18postdoctoral structured and supervised educational experience
19approved by the Council on Podiatric Medical Education of the
20American Podiatric Medical Association which includes
21residencies and preceptorships.
22    (H) "Amputations" means amputations of the human foot, in
23whole or in part, that are limited to 10 centimeters proximal
24to the tibial talar articulation.
25    (I) "Email address of record" means the designated email
26address recorded by the Department in the applicant's

1application file or the licensee's license file, as maintained
2by the Department's licensure maintenance unit.
3    (J) "Address of record" means the designated address
4recorded by the Department in the applicant's or licensee's
5application file or license file as maintained by the
6Department's licensure maintenance unit.

8    (225 ILCS 100/20.6 new)
9    Sec. 20.6. Vaccinations. A podiatric physician may provide
10vaccinations to patients 18 years of age and older upon
11completion of appropriate training. The training shall include
12how to address contraindications and adverse reactions as
13established by rule. Vaccinations administered by a podiatric
14physician shall be limited to influenza (inactivated influenza
15vaccine and live attenuated influenza intranasal vaccine),
16tetanus, and SARS-CoV-2. Vaccination of a patient by a
17podiatric physician shall be documented in the patient's
18record and the record shall be retained in accordance with
19current recordkeeping standards. The podiatric physician shall
20notify the patient's primary care physician of each dose of
21vaccine administered to the patient and shall enter all
22patient level data or update the patient's current record. The
23podiatric physician may provide this notice to the patient's
24physician electronically.".
