Provides that a law enforcement agency or law enforcement official shall not refuse to approve the use or prohibit the use of books, including, but not limited to, memoirs, autobiographies, and biographies, based upon the depiction in those materials of matters related to the protected characteristics or categories identified in the Illinois Human Rights Act in any correctional facility in the State. Defines terms. Makes corresponding changes. |

| 1 | | AN ACT concerning correctional facilities. | 2 | | Be it enacted by the People of the State of Illinois, | 3 | | represented in the General Assembly: | 4 | | Section 1. Short title. This Act may be cited as the | 5 | | Censorship in Correctional Facilities Act. | 6 | | Section 5. Definitions. As used in this Act: | 7 | | "Law enforcement agency" means an agency of the State or | 8 | | of a unit of local government charged with enforcement of | 9 | | State, county, or municipal laws or with managing custody of | 10 | | detained persons in the State. | 11 | | "Law enforcement official" means any individual with the | 12 | | power to arrest or detain individuals, including law | 13 | | enforcement officers, corrections officers, and others | 14 | | employed or designated by a law enforcement agency. "Law | 15 | | enforcement official" includes a probation officer. | 16 | | Section 10. Censorship or book bans prohibited. A law | 17 | | enforcement agency or law enforcement official shall not | 18 | | refuse to approve the use or prohibit the use of books, | 19 | | including, but not limited to, memoirs, autobiographies, and | 20 | | biographies, based upon the depiction in those materials of | 21 | | matters related to the protected characteristics or categories | 22 | | identified in subsection (Q) of Section 1-103 of the Illinois |

A person who | 6 | | violates Section 11-117-12.2 of the Illinois Municipal Code, | 7 | | Section 224.05 of the Illinois Insurance Code, Section 8-201.5 | 8 | | of the Public Utilities Act, Sections 2-1401.1, 9-107.10, | 9 | | 9-107.11, and 15-1501.6 of the Code of Civil Procedure, | 10 | | Section 4.05 of the Interest Act, the Military Personnel | 11 | | Cellular Phone Contract Termination Act, Section 405-272 of | 12 | | the Civil Administrative Code of Illinois, Section 10-63 of | 13 | | the Illinois Administrative Procedure Act, Sections 30.25 and | 14 | | 30.30 of the Military Code of Illinois, Section 16 of the | 15 | | Landlord and Tenant Act, Section 26.5 of the Retail | 16 | | Installment Sales Act, Section 10 of the Censorship in | 17 | | Correctional Facilities Act, or Section 37 of the Motor | 18 | | Vehicle Leasing Act commits a civil rights violation within | 19 | | the meaning of this Act. | 20 | | (Source: P.A. 102-558, eff. 8-20-21.) |
