| 2 | | AMENDMENT NO. ______. Amend House Bill 1600 by replacing | 3 | | everything after the enacting clause with the following: | 4 | | "Section 5. The Illinois Food, Drug and Cosmetic Act is | 5 | | amended by adding Section 16.6 as follows: | 6 | | (410 ILCS 620/16.6 new) | 7 | | Sec. 16.6. Single-use plastic disposable foodware. | 8 | | (a) In this Section: | 9 | | "Department" means the Department of Public Health. | 10 | | "Drive-through window" means any service window, automated | 11 | | device or other facility that provides goods or services to | 12 | | individuals in a motor vehicle. | 13 | | "Full-service restaurant" means a food dispensing | 14 | | establishment with the primary business purpose of serving | 15 | | food, where food may be consumed on the premises and where: | 16 | | (1) a consumer is escorted or assigned to an assigned |

| 1 | | eating area; the employee may choose the assigned eating | 2 | | area or may seat the consumer according to the consumer's | 3 | | need for accommodation or other request; | 4 | | (2) a consumer's food and beverage orders are taken | 5 | | after the consumer has been seated at the assigned seating | 6 | | area; | 7 | | (3) food and beverage orders are delivered directly to | 8 | | the consumer; | 9 | | (4) any requested items associated with a consumer's | 10 | | food or beverage order are brought to the consumer; and | 11 | | (5) the check is delivered directly to the consumer at | 12 | | the assigned eating area. | 13 | | "Quick-service restaurant" means a food dispensing | 14 | | establishment that has minimal table service, makes food | 15 | | available upon order, and allows pick-up from a vehicle. | 16 | | "Restaurant" means a full-service restaurant or | 17 | | "quick-service restaurant. | 18 | | "Sealed" means free of cracks or other openings which | 19 | | permit the entry or passage of moisture. | 20 | | "Single-use foodware" means any eating utensil or other | 21 | | item to be used as part of food or beverage service that is | 22 | | designed and intended by the manufacturer for only one usage | 23 | | before being discarded, including forks, spoons, sporks, | 24 | | knives, chopsticks, other eating utensils, stirrers, drink | 25 | | stoppers, splash sticks, cocktail sticks, toothpicks, napkins, | 26 | | wet-wipes, cup sleeves, beverage trays, disposable plates, and |

| 1 | | condiment packets. "Single-use foodware" does not include | 2 | | straws, beverage lids, or items used to contain or package | 3 | | food or beverages for delivery. | 4 | | "Takeout" means prepared food purchased from a restaurant | 5 | | to be consumed at another location. | 6 | | "Third-party food delivery platform" means a business | 7 | | engaged in the service of online food ordering and delivery | 8 | | from a restaurant to a consumer. "Third-party food delivery | 9 | | platform" does not include any individual that is directly or | 10 | | indirectly employed by the restaurant and makes deliveries on | 11 | | behalf of a restaurant. | 12 | | "Third-party online ordering platform" means a website or | 13 | | application that connects customers with restaurants for | 14 | | ordering food online. "Third-party online ordering platform" | 15 | | does not include an application or website owned and operated | 16 | | by a restaurant. | 17 | | (b) A third-party food delivery platform shall provide a | 18 | | consumer with the option to request single-use foodware when a | 19 | | consumer purchases food or beverages from a restaurant through | 20 | | the third-party food delivery platform. | 21 | | (c) A third-party online ordering platform shall provide | 22 | | consumers with the option to request single-use foodware when | 23 | | a consumer purchases food or beverages from a restaurant for | 24 | | takeout through the third-party online ordering platform. | 25 | | (d) If a restaurant uses a third-party food delivery | 26 | | platform to provide food or beverages to a consumer by |

| 1 | | delivery, or a third-party online ordering platform to provide | 2 | | food or beverages to a consumer for takeout, the restaurant | 3 | | shall provide single-use foodware to the consumer only upon | 4 | | the request of the consumer through the third-party food | 5 | | delivery platform or the third-party online ordering platform. | 6 | | (e) This Section shall not apply to: (1) single-use | 7 | | foodware necessary to address safety concerns, such as lids, | 8 | | drink stoppers, beverage trays, and cup sleeves for beverages | 9 | | served at an average temperature in excess of 170 degrees | 10 | | Fahrenheit; (2) an automatic food vending machine; (3) any | 11 | | single-use foodware that is prepackaged with or attached to | 12 | | any food or beverage products by the manufacturer prior to | 13 | | receipt by the restaurant; (4) any charitable food dispensing | 14 | | establishment; (5) restaurants located within Chicago O'Hare | 15 | | International Airport or Chicago Midway International Airport; | 16 | | or (6) single-use foodware provided in connection with any | 17 | | food or beverage order fulfilled at a drive-through window. | 18 | | (f) Notwithstanding any other provision of this Act, the | 19 | | first violation of this Section shall result in a notice of | 20 | | violation, and any subsequent violation shall be punishable by | 21 | | a civil penalty of no more than $25 per day. No restaurant, | 22 | | third-party food delivery platform, or third-party online food | 23 | | ordering platform shall be fined in excess of $250 per year for | 24 | | violations under this Section. The Department shall adopt | 25 | | rules providing for an administrative proceeding in which the | 26 | | penalty may be imposed. The Attorney General may bring an |

| 1 | | action in the circuit court to enforce the collection of any | 2 | | monetary penalty imposed. All civil penalties collected under | 3 | | this Section shall be paid to the Department. | 4 | | (g) A municipality or county, including a home rule unit, | 5 | | may not regulate the use of single-use foodware by a | 6 | | restaurant, third-party food delivery platform, third-party | 7 | | online food ordering platform, or consumer. This Section is a | 8 | | denial and limitation of home rule powers and functions under | 9 | | subsection (g) of Section 6 of Article VII of the Illinois | 10 | | Constitution. | 11 | | Section 99. Effective date. This Act takes effect January | 12 | | 1, 2026.". |
