AMENDMENT TO HOUSE BILL 1600

2    AMENDMENT NO. ______. Amend House Bill 1600 by replacing
3everything after the enacting clause with the following:
 
4    "Section 5. The Illinois Food, Drug and Cosmetic Act is
5amended by adding Section 16.6 as follows:
 
6    (410 ILCS 620/16.6 new)
7    Sec. 16.6. Single-use plastic disposable foodware.
8    (a) In this Section:
9    "Department" means the Department of Public Health.
10    "Drive-through window" means any service window, automated
11device or other facility that provides goods or services to
12individuals in a motor vehicle.
13    "Full-service restaurant" means a food dispensing
14establishment with the primary business purpose of serving
15food, where food may be consumed on the premises and where:
16        (1) a consumer is escorted or assigned to an assigned

1    eating area; the employee may choose the assigned eating
2    area or may seat the consumer according to the consumer's
3    need for accommodation or other request;
4        (2) a consumer's food and beverage orders are taken
5    after the consumer has been seated at the assigned seating
6    area;
7        (3) food and beverage orders are delivered directly to
8    the consumer;
9        (4) any requested items associated with a consumer's
10    food or beverage order are brought to the consumer; and
11        (5) the check is delivered directly to the consumer at
12    the assigned eating area.
13    "Quick-service restaurant" means a food dispensing
14establishment that has minimal table service, makes food
15available upon order, and allows pick-up from a vehicle.
16    "Restaurant" means a full-service restaurant or
17"quick-service restaurant.
18    "Sealed" means free of cracks or other openings which
19permit the entry or passage of moisture.
20    "Single-use foodware" means any eating utensil or other
21item to be used as part of food or beverage service that is
22designed and intended by the manufacturer for only one usage
23before being discarded, including forks, spoons, sporks,
24knives, chopsticks, other eating utensils, stirrers, drink
25stoppers, splash sticks, cocktail sticks, toothpicks, napkins,
26wet-wipes, cup sleeves, beverage trays, disposable plates, and

1condiment packets. "Single-use foodware" does not include
2straws, beverage lids, or items used to contain or package
3food or beverages for delivery.
4    "Takeout" means prepared food purchased from a restaurant
5to be consumed at another location.
6    "Third-party food delivery platform" means a business
7engaged in the service of online food ordering and delivery
8from a restaurant to a consumer. "Third-party food delivery
9platform" does not include any individual that is directly or
10indirectly employed by the restaurant and makes deliveries on
11behalf of a restaurant.
12    "Third-party online ordering platform" means a website or
13application that connects customers with restaurants for
14ordering food online. "Third-party online ordering platform"
15does not include an application or website owned and operated
16by a restaurant.
17    (b) A third-party food delivery platform shall provide a
18consumer with the option to request single-use foodware when a
19consumer purchases food or beverages from a restaurant through
20the third-party food delivery platform.
21    (c) A third-party online ordering platform shall provide
22consumers with the option to request single-use foodware when
23a consumer purchases food or beverages from a restaurant for
24takeout through the third-party online ordering platform.
25    (d) If a restaurant uses a third-party food delivery
26platform to provide food or beverages to a consumer by

1delivery, or a third-party online ordering platform to provide
2food or beverages to a consumer for takeout, the restaurant
3shall provide single-use foodware to the consumer only upon
4the request of the consumer through the third-party food
5delivery platform or the third-party online ordering platform.
6    (e) This Section shall not apply to: (1) single-use
7foodware necessary to address safety concerns, such as lids,
8drink stoppers, beverage trays, and cup sleeves for beverages
9served at an average temperature in excess of 170 degrees
10Fahrenheit; (2) an automatic food vending machine; (3) any
11single-use foodware that is prepackaged with or attached to
12any food or beverage products by the manufacturer prior to
13receipt by the restaurant; (4) any charitable food dispensing
14establishment; (5) restaurants located within Chicago O'Hare
15International Airport or Chicago Midway International Airport;
16or (6) single-use foodware provided in connection with any
17food or beverage order fulfilled at a drive-through window.
18    (f) Notwithstanding any other provision of this Act, the
19first violation of this Section shall result in a notice of
20violation, and any subsequent violation shall be punishable by
21a civil penalty of no more than $25 per day. No restaurant,
22third-party food delivery platform, or third-party online food
23ordering platform shall be fined in excess of $250 per year for
24violations under this Section. The Department shall adopt
25rules providing for an administrative proceeding in which the
26penalty may be imposed. The Attorney General may bring an

1action in the circuit court to enforce the collection of any
2monetary penalty imposed. All civil penalties collected under
3this Section shall be paid to the Department.
4    (g) A municipality or county, including a home rule unit,
5may not regulate the use of single-use foodware by a
6restaurant, third-party food delivery platform, third-party
7online food ordering platform, or consumer. This Section is a
8denial and limitation of home rule powers and functions under
9subsection (g) of Section 6 of Article VII of the Illinois
10Constitution.
 
11    Section 99. Effective date. This Act takes effect January
121, 2026.".
