AMENDMENT TO SENATE BILL 707

2    AMENDMENT NO. ______. Amend Senate Bill 707 by replacing
3everything after the enacting clause with the following:
 
4    "Section 5. The Nurse Practice Act is amended by adding
5Section 50-80 as follows:
 
6    (225 ILCS 65/50-80 new)
7    Sec. 50-80. Regulation of delegation in kidney disease
8treatment centers.
9    (a) Notwithstanding any provision of this Act or rule of
10the Department to the contrary, an individual working in a
11kidney disease treatment center as described in subsection (5)
12of Section 3 of the Illinois Health Facilities Planning Act
13shall be considered a licensed individual for the purposes of
14delegation under Section 50-75 of this Act. A person working
15to acquire the experience necessary to obtain certification
16under subsection (b) of this Section may practice in

1accordance with this Section for a period of no more than 18
2months if the person's practice is in compliance with the
3experience standards set forth by the entities listed in
4subsection (b).
5    (b) Notwithstanding any provision of this Act or rule of
6the Department to the contrary, delegation under this Section,
7including, but not limited to, delegation of the performance
8of central venous catheter procedures in a kidney disease
9treatment center as described in subsection (5) of Section 3
10of the Illinois Health Facilities Planning Act (including
11providing dialysis through venous catheters, initiating and
12terminating dialysis via such catheters, connecting and
13disconnecting central venous catheter lines, and maintaining
14central venous catheters through dressing changes and other
15care), shall only be allowed if the individual receiving
16delegation is a licensed practical nurse or currently holds,
17or is in the process of acquiring, the necessary experience to
18apply for and obtain one of the following certifications:
19        (1) Certified Clinical Hemodialysis Technician by the
20    Nephrology Nursing Certification Commission; or
21        (2) Certified Hemodialysis Technologist/Technician by
22    the Board of Nephrology Examiners Nursing and Technology.
23    (c) Notwithstanding any provision of this Act or rule of
24the Department to the contrary, delegation under this Section
25shall not include medication administration except for the
26administration of heparin and saline for the purposes of

1performing dialysis treatments and flushing lines and the
2application of topical anesthetics. All patient care provided
3by a certified dialysis technician practicing under this
4Section shall be under the direct and immediate on-site
5supervision of a licensed physician, advanced practice
6registered nurse, physician assistant, or registered nurse.
7    (d) Delegation under this Section shall comply with any
8rules adopted under the Illinois Health Facilities Planning
9Act and any other Illinois statute or rule regarding the
10operation of a kidney disease treatment center as described by
11this Section.
12    (e) Nothing in this Section shall be construed to apply to
13any other facility or practice setting. This Section shall not
14be construed as granting a license under this Act and shall not
15allow individuals receiving delegation under this Section to
16use any title regulated by this Act.
 
17    Section 99. Effective date. This Act takes effect upon
18becoming law.".
