| | | Amends the Sanitary Food Preparation Act. Provides that, if a food distribution facility is engaged in the collection, storage, packaging, or distribution of food to consumers, then that facility is subject to all provisions of the Act and rules adopted under the Act. Provides that the registered sanitarian of a county health department of where a food distribution facility is located shall have the power to enforce and observe the rules and orders of the Department of Public Health and the provisions of this Section. Defines "food distribution facility". |

| 2 | | Be it enacted by the People of the State of Illinois, |
| 3 | | represented in the General Assembly:

| 4 | | Section 5. The Sanitary Food Preparation Act is amended by |
| 5 | | adding Section 10.2 as follows:
|
| 6 | | (410 ILCS 650/10.2 new) |
| 7 | | Sec. 10.2. Food distribution facility; county health |
| 8 | | department. If a food distribution facility is engaged in the |
| 9 | | collection, storage, packaging, or distribution of food to |
| 10 | | consumers, then that facility is subject to all provisions of |
| 11 | | the Act and rules adopted under the Act. Notwithstanding any |
| 12 | | other provision of this Act, the registered sanitarian of a |
| 13 | | county health department of where a food distribution facility |
| 14 | | is located shall have the power to enforce and observe the |
| 15 | | rules and orders of the Department of Public Health and the |
| 16 | | provisions of this Section. In this Section, "food |
| 17 | | distribution facility" means any warehouse or other storage |
| 18 | | facility where food is being collected, stored, packaged, or |
| 19 | | distributed to consumers. |
