1 HOUSE RESOLUTION
2 WHEREAS, Changes to administrative rules, effective
3 October 15, 2002, affect the manner of filling 4-year "term
4 appointments"; and
5 WHEREAS, Those changes shorten the probationary period
6 for term appointments from 6 months to 30 days, after which
7 time an incumbent may be discharged during the 4-year term
8 appointment only for cause; and
9 WHEREAS, Those changes also permit term appointments that
10 are determined to be exempt from the requirements of the
11 Rutan decision to be filled by persons who are not on open
12 competitive or competitive promotional eligible lists; and
13 WHEREAS, Published reports indicate anywhere between 500
14 and 1,500 State positions are affected by these rule changes;
15 and
16 WHEREAS, In addition to changes to administrative rules
17 affecting a broad class of term appointments, changes have
18 recently been made to individual position descriptions,
19 resulting in the incumbents gaining civil service protection
20 for their jobs; and
21 WHEREAS, The necessity for and cost of these fundamental
22 changes to the manner in which the State fills certain
23 positions have not been studied; therefore, be it
24 RESOLVED, BY THE HOUSE OF REPRESENTATIVES OF THE
25 NINETY-THIRD GENERAL ASSEMBLY OF THE STATE OF ILLINOIS, that
26 the Auditor General is directed to conduct a management audit
27 of the impact of these significant changes in State
28 appointment practices made during recent months; and be it
29 further
30 RESOLVED, That the audit include, but need not be limited

1 to, the following determinations:
2 (1) The number of positions affected by these changes;
3 (2) The nature of the duties of such positions;
4 (3) The documented management necessity for such
5 changes;
6 (4) The fiscal cost of such positions; and
7 (5) The name, date of appointment, and salary of each
8 appointee to any of these positions; and be it further
9 RESOLVED, That any State agency or other entity that may
10 have relevant information pertaining to this audit cooperate
11 fully and promptly with the Auditor General's Office in the
12 conduct of this audit; and be it further
13 RESOLVED, That the Auditor General commence this audit as
14 soon as possible and report his findings and recommendations
15 upon completion to the Legislative Audit Commission, the
16 Governor, and the General Assembly; and be it further
17 RESOLVED, That a suitable copy of this resolution be
18 delivered to the Legislative Audit Commission, the Auditor
19 General, the Governor, the Speaker and Minority Leader of the
20 House of Representatives, and the President and Minority
21 Leader of the Senate.
