| 6 | | WHEREAS, A Petition was filed by Representative Anne | 7 | | Stava-Murray with the Clerk of the House of Representatives on | 8 | | February 4, 2020, challenging the qualifications of | 9 | | Representative Eva Dina Delgado; and
| 10 | | WHEREAS, An Amended Petition was filed by Representative | 11 | | Jim Durkin with the Clerk of the House of Representatives on | 12 | | February 27, 2020, challenging the qualifications of | 13 | | Representative Eva Dina Delgado; and
| 14 | | WHEREAS, Representative Delgado was elected as the | 15 | | Illinois House Representative for the Third District on | 16 | | November 3, 2020; and | 17 | | WHEREAS, The two petitioners either failed to prosecute or | 18 | | withdrew their respective petitions in December 2020; and | 19 | | WHEREAS, A Petition for Attorney's Fees and Costs | 20 | | requesting reimbursement was filed by Miller Shakman Levine & |

| 1 | | Feldman LLP, as counsel for Representative Delgado, with the | 2 | | Clerk of the House of Representatives on January 5, 2021; and | 3 | | WHEREAS, The One Hundred Second General Assembly commenced | 4 | | on January 13, 2021; and
| 5 | | WHEREAS, An Amended Petition for Attorney's Fees and Costs | 6 | | in the sum of $31,798 was filed by Miller Shakman Levine & | 7 | | Feldman LLP, as counsel for Representative Delgado, with the | 8 | | Clerk of the House of Representatives on March 4, 2021; and | 9 | | WHEREAS, On May 10, 2021, the House Judiciary-Civil | 10 | | Committee held a subject matter hearing on the Amended | 11 | | Petition for Attorney's Fees and Costs pursuant to House Rule | 12 | | 88(g); and
| 13 | | WHEREAS, On May 12, 2021, House Judiciary-Civil Committee | 14 | | received a supplemental declaration from Miller Shakman Levine & | 15 | | Feldman LLP, which has been duly considered as part of the | 16 | | record in ascertaining what fees and expenses are proper under | 17 | | the terms of engagement, consistent with work performed, and | 18 | | for the purpose of ascertaining what fees and expenses are | 19 | | reasonable, just, and proper under the circumstances; | 20 | | therefore, be it

| 1 | | HUNDRED SECOND GENERAL ASSEMBLY OF THE STATE OF ILLINOIS, that | 2 | | the House does approve and adopt the recommendation of the | 3 | | House Judiciary-Civil Committee that reimbursement of | 4 | | attorney's fees and expenses for the sum of, and not to exceed, | 5 | | $25,246 in this matter are reasonable, just, and proper; and | 6 | | be it further
| 7 | | RESOLVED, That the House authorizes that reimbursement sum | 8 | | from any appropriations available for that purpose.
