| AN ACT concerning transportation.
| 2 |
| Be it enacted by the People of the State of Illinois,
| 3 |
| represented in the General Assembly:
| 4 |
| Section 5. The Boat Registration and Safety Act is amended | 5 |
| by changing Section 5-7 as follows:
| 6 |
| (625 ILCS 45/5-7) (from Ch. 95 1/2, par. 315-7)

| Sec. 5-7. Restricted areas. | 8 |
| (a) No person shall operate a watercraft
within a water | 9 |
| area that has been clearly marked by buoys or some other
| 10 |
| distinguishing device as a bathing, fishing, swimming or | 11 |
| otherwise
restricted area by the Department or a political | 12 |
| subdivision of the State
or by an owner or lessee of property | 13 |
| in accordance with his or her rights
to the use of the | 14 |
| property, except in the manner prescribed by the buoys or
other | 15 |
| distinguishing devices. This Section shall not apply in the | 16 |
| case of
an emergency, or to patrol or rescue craft.
| 17 |
| (b) No person shall operate a watercraft within 150 feet of | 18 |
| a public
launching ramp owned, operated or maintained by the | 19 |
| Department or a
political subdivision of the State at greater | 20 |
| than a "No Wake" speed as
defined in Section 5-12 of this Act. | 21 |
| Posting of the areas
by the Department or a political | 22 |
| subdivision of the State is not required. | 23 |
| (c) A person may not operate an airboat on any lake that is |

| 24,000 acres in size or larger.

| (d) The Department and other political subdivisions of the | 3 |
| State may, within
their discretion and after issuing an | 4 |
| administrative rule in accordance
with the Illinois | 5 |
| Administrative Procedure Act, designate certain areas by
| 6 |
| proper signs to be bathing, fishing, swimming or otherwise | 7 |
| restricted
areas, or eliminate, alter or otherwise modify | 8 |
| existing areas. The Department
or a political subdivision of | 9 |
| the State shall further have the authority in
order to fully | 10 |
| carry out the provisions of this Act to place signs, beacons
| 11 |
| and buoys in designated areas controlling the flow of traffic.
| 12 |
| (e) It shall be unlawful for any person to deface, move, | 13 |
| obliterate, tear
down, or destroy, in whole or in part, or | 14 |
| attempt to deface, move,
obliterate, tear down or destroy any | 15 |
| buoys or signs posted pursuant to
the provisions of this Act, | 16 |
| except as authorized by the Department.
