| 2 | | Be it enacted by the People of the State of Illinois,
| 3 | | represented in the General Assembly:
| 4 | | Section 5. The Board of Higher Education Act is amended by | 5 | | changing Section 8 as follows:
| 6 | | (110 ILCS 205/8) (from Ch. 144, par. 188)
| 7 | | Sec. 8.
The Board of Trustees of the University of | 8 | | Illinois, the Board of
Trustees of Southern Illinois | 9 | | University,
the Board of Trustees of Chicago State University, | 10 | | the Board of Trustees of
Eastern Illinois University, the Board | 11 | | of Trustees of Governors State
University, the Board of | 12 | | Trustees of Illinois State University, the Board of
Trustees of | 13 | | Northeastern Illinois University, the Board of Trustees of | 14 | | Northern
Illinois University, the Board of Trustees of Western | 15 | | Illinois University, and
the Illinois Community College Board | 16 | | shall submit to the Board not later
than the 15th day of | 17 | | November of each year its budget proposals for the
operation | 18 | | and capital needs of the institutions under its governance or
| 19 | | supervision for the ensuing fiscal year. Each budget proposal | 20 | | shall conform
to the procedures developed by the Board in the | 21 | | design of an information
system for State universities and | 22 | | colleges.

| 1 | | the Board and
its staff shall communicate on a regular basis | 2 | | with all public university
presidents. They shall meet at least | 3 | | semiannually to achieve economies of
scale where possible and | 4 | | provide the most innovative and efficient programs and
| 5 | | services.
| 6 | | The Board, in the analysis of formulating the annual budget | 7 | | request,
shall consider rates of tuition and fees at the state | 8 | | universities and
colleges. The Board shall also consider the | 9 | | current and projected
utilization of the total physical plant | 10 | | of each campus of a university or
college in approving the | 11 | | capital budget for any new building or facility.
| 12 | | The Board of Higher Education shall submit to the Governor, | 13 | | to the
General Assembly, and to the appropriate budget agencies | 14 | | of the Governor
and General Assembly its analysis and | 15 | | recommendations on such budget
proposals.
| 16 | | The Board is directed to form a broad-based group of | 17 | | individuals representing the Office of the Governor, the | 18 | | General Assembly, public institutions of higher education, | 19 | | State agencies, business and industry, Statewide organizations | 20 | | representing faculty and staff, and others as the Board shall | 21 | | deem appropriate to devise a system for allocating State | 22 | | resources to public institutions of higher education based upon | 23 | | performance in achieving State goals related to student success | 24 | | and certificate and degree completion. | 25 | | Beginning in Fiscal Year 2013, the Board of Higher | 26 | | Education budget recommendations to the Governor and the |

| 1 | | General Assembly shall include allocations to public | 2 | | institutions of higher education based upon performance | 3 | | metrics designed to promote and measure student success in | 4 | | degree and certificate completion. These metrics must be | 5 | | adopted by the Board by rule and must be developed and | 6 | | promulgated in accordance with the following principles: | 7 | | (1) The metrics must be developed in consultation with | 8 | | public institutions of higher education, as well as other | 9 | | State educational agencies and other higher education | 10 | | organizations, associations, interests, and stakeholders | 11 | | as deemed appropriate by the Board. | 12 | | (2) The metrics shall include provisions for | 13 | | recognizing the demands on and rewarding the performance of | 14 | | institutions in advancing the success of students who are | 15 | | academically or financially at risk, including | 16 | | first-generation students, low-income students, and | 17 | | students traditionally underrepresented in higher | 18 | | education, as specified in Section 9.16 of this Act. | 19 | | (3) The metrics shall recognize and account for the | 20 | | differentiated missions of institutions and sectors of | 21 | | higher education. | 22 | | (4) The metrics shall focus on the fundamental goal of | 23 | | increasing completion of college courses, certificates, | 24 | | and degrees. Performance metrics shall recognize the | 25 | | unique and broad mission of public community colleges | 26 | | through consideration of additional factors including, but |

| 1 | | not limited to, enrollment, progress through key academic | 2 | | milestones, transfer to a baccalaureate institution, and | 3 | | degree completion. | 4 | | (5) The metrics must be designed to maintain the | 5 | | quality of degrees, certificates, courses, and programs. | 6 | | In devising performance metrics, the Board may be guided by the | 7 | | report of the Higher Education Finance Study Commission. | 8 | | Each state supported institution within the application of | 9 | | this Act must
submit its plan for capital improvements of | 10 | | non-instructional facilities to
the Board for approval before | 11 | | final commitments are made. Non-instructional
uses shall | 12 | | include but not be limited to dormitories, union buildings,
| 13 | | field houses, stadium, other recreational facilities and | 14 | | parking lots. The
Board shall determine whether or not any | 15 | | project submitted for approval is
consistent with the master | 16 | | plan for higher education and with instructional
buildings that | 17 | | are provided for therein. If the project is found by a
majority | 18 | | of the Board not to be consistent, such capital improvement | 19 | | shall
not be constructed.
