| 1 | | AN ACT concerning transportation.
| 2 | | Be it enacted by the People of the State of Illinois,
| 3 | | represented in the General Assembly:
| 4 | | Section 5. The Illinois Vehicle Code is amended by changing | 5 | | Section 11-1414.1 as follows:
| 6 | | (625 ILCS 5/11-1414.1) (from Ch. 95 1/2, par. 11-1414.1)
| 7 | | Sec. 11-1414.1. School transportation of students.
| 8 | | (a) Every student enrolled in grade 12 or below in any | 9 | | entity listed in subsection (a) of Section 1-182 of this Code | 10 | | must be transported in a school bus or a vehicle described in | 11 | | subdivision (1) or (2) of subsection (b) of Section 1-182 of | 12 | | this Code for any curriculum-related school activity, except a | 13 | | student in any of grades 9 through 12 or a student in any of | 14 | | grades K through 12 with an Individualized Education Plan (IEP) | 15 | | with a staff to student ratio of 1 to 5, and attending Acacia | 16 | | Academy, Alexander Leigh, Marklund, Helping Hands Center, | 17 | | Connections Organization, or New Horizon Academy may be | 18 | | transported in a multi-function school activity bus (MFSAB) as | 19 | | defined in Section 1-148.3a-5 of this Code for any | 20 | | curriculum-related activity except for transportation on | 21 | | regular bus routes from home to school or from school to home, | 22 | | subject to the following conditions: | 23 | | (i) A MFSAB may not be used to transport students under |

| 1 | | this Section unless the driver holds a valid school bus | 2 | | driver permit. | 3 | | (ii) The use of a MFSAB under this Section is subject | 4 | | to the requirements of Sections 6-106.11, 6-106.12, | 5 | | 12-707.01, 13-101, and 13-109 of this Code. | 6 | | "Curriculum-related school activity" as used in this | 7 | | subsection (a) includes transportation from home to school or | 8 | | from school to home, tripper or shuttle service between school | 9 | | attendance centers, transportation to a vocational or career | 10 | | center or other trade-skill development site or a regional safe | 11 | | school or other school-sponsored alternative learning program, | 12 | | or a trip that is directly related to the regular curriculum of | 13 | | a student for which he or she earns credit.
| 14 | | (b) Every student enrolled in grade 12 or below in any | 15 | | entity listed in subsection (a) of Section 1-182 of this Code | 16 | | who is transported in a vehicle that is being operated by or | 17 | | for a public or private primary or secondary school, including | 18 | | any primary or secondary school operated by a religious | 19 | | institution, for an interscholastic, interscholastic-athletic, | 20 | | or school-sponsored, noncurriculum-related activity that (i) | 21 | | does not require student participation as part of the | 22 | | educational services of the entity and (ii) is not associated | 23 | | with the students' regular class-for-credit schedule shall | 24 | | transport students only in a school bus or vehicle described in | 25 | | subsection (b) of Section 1-182 of this Code.
