| AN ACT concerning education, which may be referred to as | 2 |
| Brandon's Law.
| 3 |
| WHEREAS, Testicular cancer is the most common form of | 4 |
| cancer in young men between the ages of 15 and 35; and | 5 |
| WHEREAS, Testicular cancer has one of the highest cure | 6 |
| rates of all cancers, but early detection is extremely | 7 |
| important; and | 8 |
| WHEREAS, Symptoms of testicular cancer include a lump or | 9 |
| enlargement of a testicle, a dull ache in the abdomen or groin, | 10 |
| and pain or discomfort of the scrotum; family history of | 11 |
| testicular cancer, inguinal hernias, and presence of descended | 12 |
| testicles present risk factors; and | 13 |
| WHEREAS, Teenagers who are going through a multitude of | 14 |
| physical and emotional changes may be less likely to recognize | 15 |
| the symptoms of testicular cancer or tell a parent or doctor if | 16 |
| they suspect a problem; therefore
| 17 |
| Be it enacted by the People of the State of Illinois,
| 18 |
| represented in the General Assembly:
| 19 |
| Section 5. The Critical Health Problems and Comprehensive | 20 |
| Health
Education Act is amended by changing Section 3 as |

| follows:

| (105 ILCS 110/3) (from Ch. 122, par. 863)

| Sec. 3. Comprehensive Health Education Program. The | 4 |
| program established
under this Act shall include, but not be | 5 |
| limited to, the following major
educational areas as a basis | 6 |
| for curricula in all elementary and secondary
schools in this | 7 |
| State: human ecology and health, human growth and
development, | 8 |
| the emotional, psychological, physiological, hygienic and
| 9 |
| social responsibilities of family life, including sexual | 10 |
| abstinence until
marriage, prevention and control of disease, | 11 |
| including instruction in
grades 6 through 12 on the prevention, | 12 |
| transmission and spread of AIDS,
sexual assault awareness in | 13 |
| secondary schools, public and environmental health, consumer | 14 |
| health, safety education and
disaster survival, mental health | 15 |
| and illness, personal health habits,
alcohol, drug use, and | 16 |
| abuse including the medical and legal ramifications
of alcohol, | 17 |
| drug, and tobacco use, abuse during pregnancy, sexual
| 18 |
| abstinence until marriage, tobacco, nutrition, and dental | 19 |
| health. The program shall also provide course material and | 20 |
| instruction to advise pupils of the Abandoned Newborn Infant | 21 |
| Protection Act. The program shall include information about | 22 |
| cancer, including without limitation types of cancer, signs and | 23 |
| symptoms, risk factors, the importance of early prevention and | 24 |
| detection, and information on where to go for help.

| Notwithstanding the above educational areas, the following |

| areas may also
be included as a basis for curricula in all | 2 |
| elementary and secondary
schools in this State: basic first aid | 3 |
| (including, but not limited to,
cardiopulmonary resuscitation | 4 |
| and the Heimlich maneuver), early prevention
and detection of | 5 |
| cancer, heart disease, diabetes, stroke, and the
prevention of | 6 |
| child abuse, neglect, and suicide.
| 7 |
| The school board of each
public elementary and secondary | 8 |
| school in the State
shall encourage all teachers and other | 9 |
| school personnel to acquire,
develop, and maintain the | 10 |
| knowledge and skills necessary to properly
administer | 11 |
| life-saving techniques, including without limitation the
| 12 |
| Heimlich maneuver and rescue breathing.
The training shall be | 13 |
| in
accordance with standards of the
American Red Cross, the | 14 |
| American Heart Association, or another nationally
recognized | 15 |
| certifying organization.
A school board may use the
services of | 16 |
| non-governmental entities whose personnel have expertise in
| 17 |
| life-saving techniques to instruct teachers and other school | 18 |
| personnel in
these techniques. Each school board
is encouraged | 19 |
| to have in
its employ, or on its volunteer staff, at least one | 20 |
| person who is certified, by
the American Red Cross or by | 21 |
| another qualified certifying agency,
as qualified to | 22 |
| administer first aid and
cardiopulmonary resuscitation. In | 23 |
| addition, each school board is authorized to
allocate | 24 |
| appropriate portions of its institute or inservice days to | 25 |
| conduct
training programs for teachers and other school | 26 |
| personnel who have expressed an
interest in becoming qualified |

| to administer emergency first aid or
cardiopulmonary | 2 |
| resuscitation. School boards are urged to
encourage their | 3 |
| teachers and other school personnel who coach school athletic
| 4 |
| programs and other extracurricular school activities to | 5 |
| acquire, develop, and
maintain the knowledge and skills | 6 |
| necessary to properly administer first aid
and cardiopulmonary | 7 |
| resuscitation in accordance with standards and requirements
| 8 |
| established by the American Red Cross or another qualified | 9 |
| certifying agency. Subject to appropriation, the State Board of | 10 |
| Education shall establish and administer a matching grant | 11 |
| program to pay for half of the cost that a school district | 12 |
| incurs in training those teachers and other school personnel | 13 |
| who express an interest in becoming qualified to administer | 14 |
| cardiopulmonary resuscitation (which training must be in
| 15 |
| accordance with standards of the
American Red Cross, the | 16 |
| American Heart Association, or another nationally
recognized | 17 |
| certifying organization) or in learning how to use an automated | 18 |
| external defibrillator. A school district that applies for a | 19 |
| grant must demonstrate that it has funds to pay half of the | 20 |
| cost of the training for which matching grant money is sought. | 21 |
| The State Board of Education shall award the grants on a | 22 |
| first-come, first-serve basis.
| 23 |
| No pupil shall be
required to take or participate in any | 24 |
| class or course on AIDS or family
life instruction if his | 25 |
| parent or guardian submits written objection
thereto, and | 26 |
| refusal to take or participate in the course or program shall

| not be reason for suspension or expulsion of the pupil.

| Curricula developed under programs established in | 3 |
| accordance with this
Act in the major educational area of | 4 |
| alcohol and drug use and abuse shall
include classroom | 5 |
| instruction in grades 5 through 12. The instruction,
which | 6 |
| shall include matters relating to both the physical and legal | 7 |
| effects
and ramifications of drug and substance abuse, shall be | 8 |
| integrated into
existing curricula; and the State Board of | 9 |
| Education shall develop and make
available to all elementary | 10 |
| and secondary schools in this State
instructional materials and | 11 |
| guidelines which will assist the schools in
incorporating the | 12 |
| instruction into their existing curricula. In
addition, school | 13 |
| districts may offer, as part of existing curricula during
the | 14 |
| school day or as part of an after school program, support | 15 |
| services and
instruction for pupils or pupils whose parent, | 16 |
| parents, or guardians are
chemically dependent.

| Section 10. The Interscholastic Athletic Organization Act | 20 |
| is amended by adding Section 1.5 as follows: | 21 |
| (105 ILCS 25/1.5 new)

| Sec. 1.5. Cancer screening. An association or other entity | 23 |
| that has as one of its purposes promoting, sponsoring, | 24 |
| regulating, or in any manner providing for interscholastic |

| athletics or any form of athletic competition among schools and | 2 |
| students within this State shall include a question asking | 3 |
| whether a student has a family history of cancer on any | 4 |
| pre-participation examination form given to students | 5 |
| participating or seeking to participate in interscholastic | 6 |
| athletics. The association or entity may require that a | 7 |
| testicular examination be conducted as a part of any physical | 8 |
| required for a male student's participation in interscholastic | 9 |
| athletics.
