| 1 | | AN ACT concerning local government.
| 2 | | Be it enacted by the People of the State of Illinois,
| 3 | | represented in the General Assembly:
| 4 | | Section 5. The Metropolitan Water Reclamation District Act | 5 | | is amended by changing Sections 4.22, 4.23, and 4.25 as | 6 | | follows:

| 8 | | Sec. 4.22. Solicitation of political contributions by a | 9 | | commissioner or an employee. | 10 | | (a) During a commissioner's or an employee's compensated | 11 | | time, other than vacation, personal, holiday, or compensatory | 12 | | time off, the commissioner No officer or employee shall not | 13 | | solicit, orally or by letter, or
give or receive, or be in any | 14 | | manner concerned in soliciting , or giving , or
receiving any | 15 | | assessment, subscription , or contribution from any | 16 | | commissioner or employee member of
the classified civil service | 17 | | for any party or political purpose whatever. | 18 | | (b) For the purposes of this Section, "compensated time" | 19 | | means any time worked by or credited to an employee that counts | 20 | | toward any minimum work time requirement imposed as a condition | 21 | | of employment with the sanitary district, but does not include | 22 | | any designated holidays or any period when the employee is on a | 23 | | leave of absence. With respect to commissioners, "compensated |

| 1 | | time" means any period of time when the commissioner is on the | 2 | | premises under the control of the sanitary district and any | 3 | | other time when the commissioner is executing his or her | 4 | | official duties, regardless of location. | 5 | | For the purposes of this Section, "compensatory time off" | 6 | | means authorized time off earned by or awarded to an employee | 7 | | to compensate in whole or in part for time worked in excess of | 8 | | the minimum work time required of that employee as a condition | 9 | | of employment with the sanitary district.

Political contributions and campaigns. | 14 | | (a) During a commissioner's or an employee's compensated | 15 | | time, other than vacation, personal, holiday, or compensatory | 16 | | time off, a commissioner or an No officer or employee in the | 17 | | service of the sanitary district
shall not , directly or | 18 | | indirectly, give or hand over to any commissioner officer or | 19 | | employee
in said classified civil service , or to any senator , | 20 | | or representative , or
alderman, councilman , or trustee, any | 21 | | money or other valuable thing on
account of or to be applied to | 22 | | the promotion of any party or political
object whatever. | 23 | | (b) During an employee's compensated time, other than | 24 | | vacation, personal, holiday, or compensatory time off, an No | 25 | | employee in the classified service shall not take any part

| 1 | | the management or affairs of any political party or in any | 2 | | political
campaign, except to exercise his or her right as a | 3 | | citizen privately to express
his or her opinion, and to cast | 4 | | his or her vote, provided, however, that an employee
shall have | 5 | | the right to hold any public office, either by appointment or
| 6 | | election, that is not incompatible with his or her duties as an | 7 | | employee of the
District, and provided further that the such | 8 | | employee does not campaign or otherwise
engage in political | 9 | | activity during his or her compensated time other than | 10 | | vacation, personal, holiday, or compensatory time off working | 11 | | hours . | 12 | | (c) This Section shall
not be deemed to authorize conduct | 13 | | prohibited by the Federal Hatch Act by
employees subject to | 14 | | that said Act.
