Amends the Illinois Highway Code. Requires the Department of Transportation to develop and implement a performance-based specification applicable to designs for all hot mix asphalt projects, which includes minimum criteria for balancing acceptable safety and performance characteristics. Provides that the purpose of the performance-based specification is to incentivize the use of recycled materials, lower cost alternatives, and sustainable practices. Allows the Governor to appoint 2 sustainability officers for the purpose of monitoring the advancement of green technology initiatives throughout the State. Provides that within 60 days after the completion of each fiscal year, the Department shall provide a written report of the initiatives utilized in each district or region during the previous year. Provides that the report shall include an analysis of the cost effectiveness of the initiatives and shall outline the proposed initiatives for the current year. Requires the Department to send a copy of the report to the Speaker and Minority Leader of the House of Representatives and the President and Minority Leader of the Senate.

| 2 | | Be it enacted by the People of the State of Illinois,
| 3 | | represented in the General Assembly:
| 4 | | Section 5. The Illinois Highway Code is amended by changing | 5 | | Section 4-221 as follows: | 6 | | (605 ILCS 5/4-221) | 7 | | Sec. 4-221. Mix designs. | 8 | | (a) The Department shall develop and implement a | 9 | | performance-based specification applicable to designs for all | 10 | | hot mix asphalt projects, which includes minimum criteria for | 11 | | balancing acceptable safety and performance characteristics by | 12 | | utilizing testing methods approved by the American Society for | 13 | | Testing and Materials. Within the parameters of the | 14 | | performance-based specification, it shall be the goal of the | 15 | | Department to incentivize the use of recycled materials, lower | 16 | | cost alternatives, and sustainable practices, including but | 17 | | not limited to, the use of recycled asphalt shingles, warm mix | 18 | | asphalt, and ground tire rubber. In order to monitor the | 19 | | advancement of green technology initiatives, the Governor may | 20 | | appoint or designate 2 Department "sustainability officers". | 21 | | One of the officers shall be responsible for the initiatives | 22 | | within District or Region 1, and the other officer shall be | 23 | | responsible for the initiatives throughout the remainder of the |

A copy of the report shall be sent to the | 8 | | Speaker and Minority Leader of the House of Representatives and | 9 | | the President and Minority Leader of the Senate. | 10 | | (b) To the extent allowed by federal law, the Department | 11 | | specifications shall allow the use of recycled asphalt roofing | 12 | | shingles received from facilities authorized to process | 13 | | asphalt roofing shingles for recycling into asphalt pavement in | 14 | | accordance with (i) permits issued pursuant to Section 39 of | 15 | | the Environmental Protection Act or (ii) beneficial use | 16 | | determinations issued pursuant to Section 22.54 of the | 17 | | Environmental Protection Act. In creating the mix designs used | 18 | | for construction and maintenance of State highways, it shall be | 19 | | the goal of the Department, through its specifications, to | 20 | | maximize the percentage of recycled asphalt roofing shingles | 21 | | and binder replacement and to maximize the use of recycled | 22 | | aggregates and other lowest-cost constituents in the mix so | 23 | | long as there is no detrimental impact on life-cycle costs.
