| 1 | | AN ACT concerning revenue.
| 2 | | Be it enacted by the People of the State of Illinois,
| 3 | | represented in the General Assembly:
| 4 | | Section 5. The State Finance Act is amended by adding | 5 | | Sections 5.866 and 5.867 as follows: | 6 | | (30 ILCS 105/5.866 new) | 7 | | Sec. 5.866. The U.S.S. Illinois Commissioning Fund. This | 8 | | Section is repealed on December 31, 2017. | 9 | | (30 ILCS 105/5.867 new) | 10 | | Sec. 5.867. The Autism Care Fund. | 11 | | Section 10. The Illinois Income Tax Act is amended by | 12 | | adding Section 507DDD, 507EEE, and 507FFF as follows: | 13 | | (35 ILCS 5/507DDD new) | 14 | | Sec. 507DDD. Special Olympics Illinois and Special | 15 | | Children's Checkoff. For taxable years beginning on or after | 16 | | January 1, 2015, the Department shall print on its standard | 17 | | individual income tax form a provision indicating that if the | 18 | | taxpayer wishes to contribute to the Special Olympics Illinois | 19 | | and Special Children's Charities Checkoff Fund as authorized by | 20 | | this amendatory Act of the 99th General Assembly, he or she may |

| 1 | | do so by stating the amount of the contribution (not less than | 2 | | $1) on the return and that the contribution will reduce the | 3 | | taxpayer's refund or increase the amount of payment to | 4 | | accompany the return. Failure to remit any amount of increased | 5 | | payment shall reduce the contribution accordingly. This | 6 | | Section shall not apply to an amended return. For the purpose | 7 | | of this Section, the Department of Revenue must distribute the | 8 | | moneys as provided in 21.9(b) of the Illinois Lottery Law: (i) | 9 | | 75% of the moneys to Special Olympics Illinois to support the | 10 | | statewide training, competitions, and programs for future | 11 | | Special Olympics athletes; and (ii) 25% of the moneys to | 12 | | Special Children's Charities to support the City of | 13 | | Chicago-wide training, competitions, and programs for future | 14 | | Special Olympics athletes. | 15 | | (35 ILCS 5/507EEE new) | 16 | | Sec. 507EEE. U.S.S. Illinois Commissioning Fund checkoff. | 17 | | For taxable
years ending on or after December 31, 2014 and | 18 | | ending on or before December 31, 2016, the Department must

| 20 | | (i) indicating that if the taxpayer wishes to contribute to the
| 21 | | U.S.S. Illinois Commissioning Fund, a special fund created in | 22 | | the State treasury, for the purpose of donating to the U.S.S. | 23 | | Illinois Commissioning Committee, as authorized by this | 24 | | amendatory Act of
the 99th General Assembly, he or she may do | 25 | | so by stating the
amount of the contribution (not less than $1) |

Illinois Commissioning Fund from contributions | 7 | | under this Section shall be used by the Department of Military | 8 | | Affairs to make grants to the U.S.S. Illinois Commissioning | 9 | | Committee. This Section does not apply to any
amended return. | 10 | | This Section is repealed on December 31, 2017.

(ii) stating | 21 | | that the contribution will reduce the taxpayer's refund or
| 22 | | increase the amount of payment to accompany the return. Failure
| 23 | | to remit any amount of increased payment shall reduce the
| 24 | | contribution accordingly. Notwithstanding any other provision | 25 | | of law, moneys deposited into the Autism Care Fund from |

| 1 | | contributions under this Section shall be used by the | 2 | | Department of Human Services to make grants to the Autism | 3 | | Society of Illinois. This Section does not apply to any
amended | 4 | | return.
| 5 | | Section 99. Effective date. This Act takes effect upon | 6 | | becoming law.
