CONSTITUTIONAL AMENDMENT SC0020 Introduced 10/20/2015, by Sen. Michael Noland SYNOPSIS AS INTRODUCED: |

| Proposes to amend the Legislature Article of the Illinois Constitution. Limits a person's service in the office of Speaker of the House of Representatives, President of the Senate, Minority Leader of the House, or Minority Leader of the Senate to 8 years in any one office. Proposes to amend the Executive Article of the Illinois Constitution. Limits a person's service in an Executive Branch office to a total of 8 years in any one Executive Branch office. Effective upon being declared adopted and applies to Legislative Branch service on or after the second Wednesday in January, 2017 and Executive Branch service on or after the second Monday in January, 2017.

| 3 | | RESOLVED, BY THE SENATE OF THE NINETY-NINTH GENERAL | 4 | | ASSEMBLY OF THE STATE OF ILLINOIS, THE HOUSE OF REPRESENTATIVES | 5 | | CONCURRING HEREIN, that there shall be submitted to the | 6 | | electors of the State for adoption or rejection at the general | 7 | | election next occurring at least 6 months after the adoption of | 8 | | this resolution a proposition to amend the Illinois | 9 | | Constitution in Article IV by changing Section 6 and in Article | 10 | | V by changing Section 2 as follows:

| 12 | | THE LEGISLATURE

| 14 | | SECTION 6. ORGANIZATION
| 15 | | (a) A majority of the members elected to each house | 16 | | constitutes a
quorum.
| 17 | | (b) On the first day of the January session of the General | 18 | | Assembly
in odd-numbered years, the Secretary of State shall | 19 | | convene the House of
Representatives to elect from its | 20 | | membership a Speaker of the House of
Representatives as | 21 | | presiding officer, and the Governor shall convene the
Senate to | 22 | | elect from its membership a President of the Senate as
| 23 | | presiding officer. A person may serve no more than 8 years in |

| 1 | | any one of the following offices: Speaker of the House of | 2 | | Representatives, President of the Senate, Minority Leader of | 3 | | the House of Representatives, or Minority Leader of the Senate; | 4 | | provided that service before the second Wednesday in January of | 5 | | 2017 shall not be considered in the calculation of a person's | 6 | | service.
| 7 | | (c) For purposes of powers of appointment conferred by this
| 8 | | Constitution, the Minority Leader of either house is a member | 9 | | of the
numerically strongest political party other than the | 10 | | party to which the
Speaker or the President belongs, as the | 11 | | case may be.
| 12 | | (d) Each house shall determine the rules of its | 13 | | proceedings, judge
the elections, returns and qualifications | 14 | | of its members and choose its
officers. No member shall be | 15 | | expelled by either house, except by a vote
of two-thirds of the | 16 | | members elected to that house. A member may be
expelled only | 17 | | once for the same offense. Each house may punish by
| 18 | | imprisonment any person, not a member, guilty of disrespect to | 19 | | the house
by disorderly or contemptuous behavior in its | 20 | | presence. Imprisonment
shall not extend beyond twenty-four | 21 | | hours at one time unless the person
persists in disorderly or | 22 | | contemptuous behavior.

| 2 | | (ILCON Art. V, Sec. 2)
| 3 | | SECTION 2. TERMS
| 4 | | These elected officers of the Executive Branch shall hold | 5 | | office for
four years beginning on the second Monday of January | 6 | | after their
election and, except in the case of the Lieutenant | 7 | | Governor, until their
successors are qualified. They shall be | 8 | | elected at the general election
in 1978 and every four years | 9 | | thereafter. A person may serve no more than a total of 8 years | 10 | | in any one Executive Branch office. Service before the second | 11 | | Monday in January 2017 shall not be considered in the | 12 | | calculation of a person's service.

| 15 | | This Constitutional Amendment takes effect upon being | 16 | | declared adopted in accordance with Section 7 of the Illinois | 17 | | Constitutional Amendment Act.
