Amends the Criminal Code of 2012. Expands the crime of bribery to include an elector of the President and Vice-President of the United States (in addition to public officers, public
employees, jurors, and witnesses).

| 1 | | AN ACT concerning criminal law.
| 2 | | Be it enacted by the People of the State of Illinois,
| 3 | | represented in the General Assembly:
| 4 | | Section 5. The Criminal Code of 2012 is amended by | 5 | | changing Section 33-1 as follows:
| 6 | | (720 ILCS 5/33-1) (from Ch. 38, par. 33-1)
| 7 | | Sec. 33-1. Bribery. A person commits bribery when:
| 8 | | (a) With intent to influence the performance of any | 9 | | act related
to the employment or function of any public | 10 | | officer, public
employee, elector of President and | 11 | | Vice-President of the United States, juror or witness, he | 12 | | or she promises or tenders to that person
any property or | 13 | | personal advantage which he or she is not authorized by
| 14 | | law to accept; or
| 15 | | (b) With intent to influence the performance of any | 16 | | act related
to the employment or function of any public | 17 | | officer, public
employee, elector of President and | 18 | | Vice-President of the United States, juror or witness, he | 19 | | or she promises or tenders to one whom he
or she believes | 20 | | to be a public officer, public employee, elector of | 21 | | President and Vice-President of the United States, juror | 22 | | or witness,
any property or personal advantage which a | 23 | | public officer, public
employee, elector of President and |

| 1 | | Vice-President of the United States, juror or witness | 2 | | would not be authorized by law to accept; or
| 3 | | (c) With intent to cause any person to influence the | 4 | | performance
of any act related to the employment or | 5 | | function of any public
officer, public employee, elector | 6 | | of President and Vice-President of the United States, | 7 | | juror or witness, he or she promises or tenders
to that | 8 | | person any property or personal advantage which he or she | 9 | | is not
authorized by law to accept; or
| 10 | | (d) He or she receives, retains or agrees to accept | 11 | | any property or
personal advantage which he or she is not | 12 | | authorized by law to accept
knowing that the property or | 13 | | personal advantage was promised
or tendered with intent to | 14 | | cause him or her to influence the performance
of any act | 15 | | related to the employment or function of any public
| 16 | | officer, public employee, elector of President and | 17 | | Vice-President of the United States, juror or witness; or
| 18 | | (e) He or she solicits, receives, retains, or agrees | 19 | | to accept any property
or personal advantage pursuant to | 20 | | an understanding that he or she shall improperly
influence | 21 | | or attempt to influence the performance of any act related | 22 | | to the
employment or function of any public officer, | 23 | | public employee, elector of President and Vice-President | 24 | | of the United States, juror or witness.
| 25 | | As used in this Section, "tenders" means any delivery or | 26 | | proffer made with the requisite intent. |

| 1 | | Sentence. Bribery is a Class 2 felony.
