| 1 | | AN ACT concerning local government.
| 2 | | Be it enacted by the People of the State of Illinois,
| 3 | | represented in the General Assembly:
| 4 | | Section 5. The Illinois Municipal Code is amended by | 5 | | changing Section 3.1-20-10 as follows:
| 6 | | (65 ILCS 5/3.1-20-10) (from Ch. 24, par. 3.1-20-10)
| 7 | | Sec. 3.1-20-10. Aldermen; number.
| 8 | | (a) Except as otherwise provided in subsections (b) and (c) | 9 | | of this
Section, Section 3.1-20-20, or as otherwise provided in | 10 | | the case of
aldermen-at-large,
the number of aldermen, when not | 11 | | elected by the minority
representation plan, shall be | 12 | | determined using the most recent federal decennial census | 13 | | results as follows: in cities not exceeding 3,000
inhabitants, | 14 | | 6 aldermen; exceeding 3,000 but not exceeding 15,000, 8 | 15 | | aldermen;
exceeding 15,000 but not exceeding 20,000, 10 | 16 | | aldermen; exceeding 20,000 but
not exceeding 50,000, 14 | 17 | | aldermen; exceeding 50,000 but not exceeding 70,000,
16 | 18 | | aldermen; exceeding 70,000 but not exceeding 90,000, 18 | 19 | | aldermen; and from
90,000 to 500,000, 20 aldermen. No | 20 | | redistricting shall be required in order
to reduce the number | 21 | | of aldermen in order to comply with this Section.
| 22 | | (b) Instead of the number of aldermen set forth in | 23 | | subsection (a), a
municipality with 15,000 or more inhabitants |

| 1 | | may adopt, either by ordinance
or by resolution, not more than | 2 | | one year after the municipality's receipt of the new federal | 3 | | decennial census
results, the following number of aldermen: in | 4 | | cities exceeding 15,000 but not
exceeding 20,000, 8 aldermen; | 5 | | exceeding 20,000 but not
exceeding 50,000, 10 aldermen; | 6 | | exceeding 50,000 but not exceeding 70,000, 14
aldermen; | 7 | | exceeding 70,000 but not exceeding 90,000, 16 aldermen; and | 8 | | exceeding
90,000 but not exceeding 500,000, 18 aldermen.
| 9 | | (c) Instead of the number of aldermen set forth in | 10 | | subsection (a), a
municipality with 40,000 or more inhabitants | 11 | | may adopt, either by ordinance
or by resolution, not more than | 12 | | one year after the municipality's receipt of the new federal | 13 | | decennial census
results, the following number of aldermen: in | 14 | | cities exceeding 40,000 but
not exceeding 50,000, 16 aldermen.
| 15 | | (d) If, according to the most recent federal decennial | 16 | | census results, the population of a municipality increases | 17 | | under this Section, then the municipality may adopt an | 18 | | ordinance or resolution to retain the number of aldermen that | 19 | | existed before the most recent federal decennial census | 20 | | results. The ordinance or resolution may not be adopted more | 21 | | than one year after the municipality's receipt of the most | 22 | | recent federal decennial census results. | 23 | | (Source: P.A. 96-1156, eff. 7-21-10.)
| 24 | | Section 99. Effective date. This Act takes effect upon | 25 | | becoming law.
