Amends the State Comptroller Act. Provides that the State Comptroller is
authorized during State fiscal years 2022 and 2023 to acquire
real property located in the City of Springfield, which the State Comptroller deems necessary to properly carry out
the powers and duties vested in him or her. Provides further powers and duties concerning the acquisition of such real property. Creates the Capital Facility and Technology Modernization Fund as a special fund in the State treasury. Provides for the use of moneys in the Fund. Amends the Department of Central Management Services Law of the
Civil Administrative Code of Illinois. Provides that, to the extent possible, any relocated State employment positions and offices shall be relocated to the City of Springfield, as the State capitol, and to downtown Springfield specifically. Authorizes the Department of Central Management Services to purchase real property in Springfield for relocation purposes. Amends the State Finance Act to provide for the Capital Facility and Technology Modernization Fund. Effective immediately.

| 2 | | Be it enacted by the People of the State of Illinois,
| 3 | | represented in the General Assembly:
| 4 | | Section 5. The State Comptroller Act is amended by adding | 5 | | Section 28 as follows: | 6 | | (15 ILCS 405/28 new) | 7 | | Sec. 28. State Comptroller purchase of real property. | 8 | | (a) Subject to the provisions of the Public Contract Fraud
| 9 | | Act, the State Comptroller, on behalf of the State of | 10 | | Illinois, is
authorized during State fiscal years 2022 and | 11 | | 2023 to acquire
real property located in the City of | 12 | | Springfield, as the State capitol, which the State Comptroller | 13 | | deems necessary to properly carry out
the powers and duties | 14 | | vested in him or her. Real property
acquired under this | 15 | | Section may be acquired subject to any
third party interests | 16 | | in the property that do not prevent the
State Comptroller from | 17 | | exercising the intended beneficial use of
such property. This | 18 | | subsection (a) is inoperative on and after July 1, 2023. | 19 | | (b) Subject to the provisions of the Comptroller's
| 20 | | Procurement Rules, which shall be substantially in accordance
| 21 | | with the requirements of the Illinois Procurement Code, the
| 22 | | State Comptroller may: | 23 | | (1) enter into contracts relating to construction,

| 1 | | reconstruction, or renovation projects for any such
| 2 | | buildings or lands acquired under subsection (a); and | 3 | | (2) equip, lease, repair, operate, and maintain those | 4 | | grounds,
buildings, and facilities as may be appropriate | 5 | | to carry out
his or her statutory purposes and duties. | 6 | | (c) The State Comptroller may enter into agreements for | 7 | | the purposes of exercising his or her authority under this | 8 | | Section. | 9 | | (d) The exercise of the authority vested in the | 10 | | Comptroller to acquire
property under this
Section is subject | 11 | | to appropriation. | 12 | | (e) The Capital Facility and Technology Modernization Fund | 13 | | is hereby created as a special fund in the State treasury. | 14 | | Subject to appropriation, moneys in the Fund shall be used by | 15 | | the Comptroller for the purchase, reconstruction, lease, | 16 | | repair, and maintenance of real property as may be acquired | 17 | | under this Section, including for expenses related to the | 18 | | modernization and maintenance of information technology | 19 | | systems and infrastructure. | 20 | | Section 10. The Department of Central Management Services | 21 | | Law of the
Civil Administrative Code of Illinois is amended by | 22 | | changing Section 405-413 as follows: | 23 | | (20 ILCS 405/405-413) | 24 | | Sec. 405-413. Geographic consolidation of State employment |

| 1 | | positions. | 2 | | (a) Notwithstanding any other law to the contrary, the | 3 | | Director of Central Management Services, working in | 4 | | consultation with the Director of any affected State agency, | 5 | | shall direct the relocation to Sangamon County of all State | 6 | | employment positions under the Personnel Code that are not | 7 | | required by their nature or function to be located in a | 8 | | specific geographic area. | 9 | | (b) Notwithstanding any other law to the contrary, the | 10 | | Director of Central Management Services, working in | 11 | | consultation with the Director of any affected State agency, | 12 | | shall direct all new State employment positions which may be | 13 | | created under the Personnel Code, and which are not required | 14 | | by their nature or function to be located in a specific | 15 | | geographic area, to be located in Sangamon County. | 16 | | (c) The Director shall determine a geographic location for | 17 | | each State employment position and, if it is other than | 18 | | Sangamon County, the reason for it to be in that geographic | 19 | | location. In determining whether to locate or relocate a State | 20 | | employment position to Sangamon County, the Director shall | 21 | | consult the Director of any affected State agency as to | 22 | | whether the nature or function of a position requires it to be | 23 | | located in a specific geographic area of the State. If no such | 24 | | geographic necessity exists, that position shall be located or | 25 | | relocated to Sangamon County. | 26 | | (d) The rights of employees and the State and its agencies |

| 1 | | under the Personnel Code and applicable collective bargaining | 2 | | agreements with respect to the relocation of current State | 3 | | employee position holders shall not be affected by the | 4 | | provisions of this Section. The provisions of this Section | 5 | | regarding location or relocation of a position to Sangamon | 6 | | County shall apply only to State employment positions that | 7 | | become vacant or are created on or after the effective date of | 8 | | this amendatory Act of the 100th General Assembly. | 9 | | (e) The provisions of this Section do not apply to: (1) any | 10 | | office of the legislative or judicial branch; (2) Statewide | 11 | | offices under the jurisdiction of any executive branch | 12 | | constitutional officer other than the Governor; or (3) persons | 13 | | employed directly by the Office of the Governor. This Section | 14 | | does apply to departments and agencies of State government | 15 | | under the jurisdiction of the Governor other than persons | 16 | | employed directly by the Office of the Governor.
| 17 | | (f) To the extent possible, any State employment positions | 18 | | and offices relocated under this Section shall be relocated to | 19 | | the City of Springfield, as the State capitol, and to downtown | 20 | | Springfield specifically. The Department is authorized to | 21 | | purchase real property in Springfield for the purposes of this | 22 | | subsection (f). | 23 | | (Source: P.A. 100-742, eff. 8-9-18.) | 24 | | Section 15.
