Creates the Limitations on Private Military Contractors Act. Requires training to be directly supervised by, and training personnel certified by, the Illinois State Law Enforcement Standards and Training Board or the Illinois State Police. Prohibits use as an armed force except under an emergency order of the Governor. Effective immediately.

| AN ACT concerning private military contractors.
| 2 |
| Be it enacted by the People of the State of Illinois,
| 3 |
| represented in the General Assembly:
| 4 |
| Section 1. Short title. This Act may be cited as the | 5 |
| Limitations on Private Military
Contractors Act. | 6 |
| Section 5. Definitions.
| 7 |
| (a) The term "private military company" means a corporation | 8 |
| or private business entity that supplies materials and | 9 |
| equipment designed for use in military combat or military | 10 |
| training or that supplies, on contract, personnel with | 11 |
| specialized operational and tactical skills of a military | 12 |
| nature, including, but not limited to, combat experience. A | 13 |
| private military company may also be known as a private | 14 |
| military contractor, private military corporation, military | 15 |
| service provider, or privatized military firm. This Act, | 16 |
| however, does not apply to any person or entity that is | 17 |
| licensed under the Private Detective, Private Alarm, Private | 18 |
| Security, Fingerprint Vendor, and Locksmith Act of 2004. | 19 |
| (b) "Contract" means any agreement, including, but not | 20 |
| limited to, a prime contract, a subcontract at any tier under | 21 |
| any prime contract, or a task order issued under a task or | 22 |
| delivery order contract. | 23 |
| (c) "Designed for use in military combat" includes, but is |

| not limited to, any fully automatic firearm and any explosive | 2 |
| device not intended for entertainment or demolition purposes.

| Section 10. No unsupervised training. No tactics, weapons, | 4 |
| or explosives designed for use in military combat may be used | 5 |
| to train any person at any training facility in the State of | 6 |
| Illinois operated by a private military company, unless that | 7 |
| training is directly supervised by the Illinois State Law | 8 |
| Enforcement Standards and Training Board or the Illinois State | 9 |
| Police.

| Section 15. Certification required. All personnel employed | 11 |
| by a private military company who provide training in the use | 12 |
| of weapons, military tactics, or law enforcement emergency | 13 |
| response tactics must be certified by the Illinois State Law | 14 |
| Enforcement Standards and Training Board or approved by the | 15 |
| Illinois State Police.
| 16 |
| Section 20. No use as armed force. No personnel supplied | 17 |
| through or employed by a private military company may be used | 18 |
| as an armed force to police, patrol, guard, or arrest any | 19 |
| Illinois resident or citizen at any time except under an | 20 |
| emergency order of the Governor of the State of Illinois.

| Section 99. Effective date. This Act takes effect upon | 22 |
| becoming law.
