| 1 | | AN ACT concerning transportation.
| 2 | | Be it enacted by the People of the State of Illinois,
| 3 | | represented in the General Assembly:
| 4 | | Section 5. The Illinois Vehicle Code is amended by changing | 5 | | Section 12-201 as follows:
| 6 | | (625 ILCS 5/12-201) (from Ch. 95 1/2, par. 12-201)
| 7 | | Sec. 12-201. When lighted lamps are required.
| 8 | | (a) When operated upon any highway in this State, every | 9 | | motorcycle shall at
all times exhibit at least one lighted | 10 | | lamp, showing a white light visible
for at least 500 feet in | 11 | | the
direction the motorcycle is proceeding. However, in lieu of | 12 | | such lighted
lamp, a motorcycle may be equipped with and use a | 13 | | means of modulating the
upper beam of the head lamp between | 14 | | high and a lower brightness. No such
head lamp shall be | 15 | | modulated, except to otherwise comply with this Code,
during | 16 | | times when lighted lamps are required for other motor vehicles.
| 17 | | (b) All other motor vehicles shall
exhibit at least 2 | 18 | | lighted head lamps, with at least one on each side
of the front | 19 | | of the vehicle, which satisfy United States Department of
| 20 | | Transportation requirements, showing white lights, including | 21 | | that emitted
by high intensity discharge (HID) lamps, or lights | 22 | | of a yellow or amber tint,
during the period from sunset to | 23 | | sunrise, at times when rain, snow, fog, or
other atmospheric |

| 1 | | conditions require the use of windshield wipers, and at
any | 2 | | other times when, due to insufficient light or unfavorable | 3 | | atmospheric
conditions, persons and vehicles on the highway are | 4 | | not clearly discernible at
a distance of 1000 feet. Parking | 5 | | lamps may be used in addition to but not in
lieu of such head | 6 | | lamps. Every motor vehicle, trailer, or semi-trailer shall
also | 7 | | exhibit at least 2 lighted lamps, commonly known as tail lamps, | 8 | | which
shall be mounted on the left rear and right rear of the | 9 | | vehicle so as to throw
a red light visible for at least 500 | 10 | | feet in the reverse direction, except that
a truck tractor or | 11 | | road tractor manufactured before January 1, 1968 and all
| 12 | | motorcycles need be equipped with only one such tail lamp.
| 13 | | (b-5) During all other times not specified under subsection | 14 | | (b) of this Section, when operated upon a Class II or Class III | 15 | | highway with 2 lanes of traffic outside the corporate limits of | 16 | | a municipality, every motor vehicle of the first division or | 17 | | motor vehicle of the second division weighing no more than | 18 | | 8,000 pounds shall at all times exhibit: (1) daytime running | 19 | | lights; or (2) at least 2 lighted head lamps, with at least one | 20 | | on each side of the front of the vehicle, and which satisfy | 21 | | United States Department of Transportation requirements, | 22 | | showing white lights, including those emitted by high intensity | 23 | | discharge (HID) lamps or lights of a yellow or amber tint. A | 24 | | violation of this subsection (b-5) is a business offense | 25 | | punishable by a fine of $100. | 26 | | For purposes of this subsection (b-5), "daytime running |

| 1 | | lights" means an automotive lighting device on the front of a | 2 | | motor vehicle that is automatically switched on when the | 3 | | vehicle is moving forward and emits a white, yellow, or amber | 4 | | light. | 5 | | (c) Either a tail lamp or a separate lamp shall be so | 6 | | constructed
and placed as to illuminate with a white light a | 7 | | rear registration plate
when required and render it clearly | 8 | | legible from a distance of 50 feet
to the rear. Any tail lamp | 9 | | or tail lamps, together with any separate
lamp or lamps for | 10 | | illuminating a rear registration plate, shall be so
wired as to | 11 | | be lighted whenever the head lamps or auxiliary driving lamps
| 12 | | are lighted.
| 13 | | (d) A person shall install only head lamps that satisfy | 14 | | United States
Department of Transportation regulations and | 15 | | show white light, including that
emitted by HID lamps, or light | 16 | | of a yellow or amber tint for use by a motor
vehicle.
