| 1 | | AN ACT concerning elections.
| 2 | | Be it enacted by the People of the State of Illinois,
| 3 | | represented in the General Assembly:
| 4 | | Section 5. The Election Code is amended by changing | 5 | | Section 19-13 as follows:
| 6 | | (10 ILCS 5/19-13) (from Ch. 46, par. 19-13)
| 7 | | Sec. 19-13. Any qualified voter who has been admitted to a | 8 | | hospital, nursing home, or rehabilitation center
due to an | 9 | | illness or physical injury or a qualified voter who is in | 10 | | quarantine not more than 14 days before an election
shall be | 11 | | entitled to personal delivery of a vote by mail ballot in the | 12 | | hospital, nursing home, or rehabilitation center , or place of | 13 | | quarantine
subject to the following conditions:
| 14 | | (1) The voter completes the Application for Physically | 15 | | Incapacitated
Elector as provided in Section 19-3, stating as | 16 | | reasons therein that he is
a patient in ............... (name | 17 | | of hospital/home/center), ............... located
at, | 18 | | ............... (address of hospital/home/center), | 19 | | ............... (county,
city/village), was admitted for | 20 | | ............... (nature of illness or
physical injury), on | 21 | | ............... (date of admission), and does not
expect to be | 22 | | released from the hospital/home/center on or before the day of | 23 | | election or, if released, is expected to be homebound on the |

| 1 | | day of the election and unable to travel to the polling place.
| 2 | | (2) The voter's physician, advanced practice registered | 3 | | nurse, or physician assistant completes a Certificate of | 4 | | Attending Health Care Professional
in a form substantially as | 5 | | follows:
| 6 | | CERTIFICATE OF ATTENDING HEALTH CARE PROFESSIONAL
| 7 | | I state that I am a physician, advanced practice | 8 | | registered nurse, or physician assistant, duly licensed to | 9 | | practice in the State of
.........; that .......... is a | 10 | | patient in .......... (name of hospital/home/center),
located | 11 | | at ............. (address of hospital/home/center), | 12 | | ................. (county,
city/village); that such individual | 13 | | was admitted for ............. (nature
of illness or physical | 14 | | injury), on ............ (date of admission); and
that I have | 15 | | examined such individual in the State in which I am licensed
to | 16 | | practice and do not expect such individual to be released from
| 17 | | the hospital/home/center on or before the day of election or, | 18 | | if released, to be able to travel to the polling place on | 19 | | election day.
| 20 | | Under penalties as provided by law pursuant to Section | 21 | | 29-10 of The Election
Code, the undersigned certifies that the | 22 | | statements set forth in this
certification are true and | 23 | | correct.

| 1 | | precinct as the admitted voter or any legal relative of the | 2 | | admitted voter may
present such voter's vote by mail ballot | 3 | | application, completed as prescribed
in paragraph 1, | 4 | | accompanied by the physician's, advanced practice registered | 5 | | nurse's, or a physician assistant's certificate, completed as
| 6 | | prescribed in paragraph 2, to the election authority.
Such | 7 | | precinct voter or relative shall execute and sign an affidavit | 8 | | furnished
by the election authority attesting that he is a | 9 | | registered voter in the
same precinct as the admitted voter or | 10 | | that he is a legal relative of
the admitted voter and stating | 11 | | the nature of the
relationship. Such precinct voter or | 12 | | relative shall further attest that
he has been authorized by | 13 | | the admitted voter to obtain his or her vote by mail ballot
| 14 | | from the election authority and deliver such ballot to him in | 15 | | the hospital, home, or center.
| 16 | | Upon receipt of the admitted voter's application, | 17 | | physician's, advanced practice registered nurse's, or a | 18 | | physician assistant's
certificate, and the affidavit of the | 19 | | precinct voter or the relative, the
election authority shall | 20 | | examine the registration records to determine if
the applicant | 21 | | is qualified to vote and, if found to be qualified, shall
| 22 | | provide the precinct voter or the relative the vote by mail | 23 | | ballot for delivery
to the applicant.
| 24 | | Upon receipt of the vote by mail ballot, the admitted | 25 | | voter shall mark the
ballot in secret and subscribe to the | 26 | | certifications on the vote by mail ballot
return envelope. |

| 1 | | After depositing the ballot in the return envelope and
| 2 | | securely sealing the envelope, such voter shall give the | 3 | | envelope to the
precinct voter or the relative who shall | 4 | | deliver it to the election authority
in sufficient time for | 5 | | the ballot to be delivered by the election authority
to the | 6 | | election authority's central ballot counting location
before 7 | 7 | | p.m. on election day.
| 8 | | Upon receipt of the admitted voter's vote by mail ballot,
| 9 | | the ballot shall be counted in the manner prescribed in this | 10 | | Article.
