| 1 | | AN ACT concerning education.
| 2 | | Be it enacted by the People of the State of Illinois,
| 3 | | represented in the General Assembly:
| 4 | | Section 1. Short title. This Act may be cited as the | 5 | | Student Parent Data Collection Act. | 6 | | Section 5. Definitions. In this Act: | 7 | | "Parent" means the parent or legal guardian of a child who | 8 | | is under the age of 18 years. | 9 | | "Public institution of higher education" or "institution" | 10 | | means a public community college or public university in this | 11 | | State.
| 12 | | Section 10. Student parent data collection. | 13 | | (a) The Board of Higher Education, in consultation with | 14 | | the Illinois Community College Board, public institutions of | 15 | | higher education, and advocates, shall prepare a question or | 16 | | questions to be placed on one or more forms that are used by an | 17 | | institution on an annual basis to collect demographic data | 18 | | from its students for the purpose of determining the parental | 19 | | status or legal guardian status of each of its enrolled | 20 | | students. | 21 | | (b) The data collected under subsection (a) must be | 22 | | disaggregated by all variables collected normally, including, |

| 1 | | but not limited to, the student's race, ethnicity, income, | 2 | | gender, age, enrollment status, type of credential sought, | 3 | | receipt of financial aid, grade point average, persistence | 4 | | toward a degree or credential, and completion outcomes. | 5 | | Section 15. Campus child care. Beginning September 1, | 6 | | 2021, each public institution of higher education that | 7 | | operates one or more child care centers or early learning | 8 | | centers on its campus or is otherwise affiliated with a child | 9 | | care center or early learning center shall collect all of the | 10 | | following information: | 11 | | (1) The total number of children who are served by | 12 | | each child care center or early learning center per | 13 | | semester. | 14 | | (2) The number of children of students who are | 15 | | enrolled at the institution who are served by each child | 16 | | care center or early learning center per semester. | 17 | | Section 20. Reporting requirements. | 18 | | (a) On or before July 1, 2022 and annually thereafter, | 19 | | each public university shall report the data collected under | 20 | | Sections 10 and 15 to the Board of Higher Education, and each | 21 | | public community college shall report the data collected under | 22 | | Sections 10 and 15 to the Illinois Community College Board. | 23 | | (b) Each institution, the Board of Higher Education, and | 24 | | the Illinois Community College Board shall make the data |

| 1 | | reported under subsection (a) publicly available annually on | 2 | | their Internet websites. | 3 | | (c) The Board of Higher Education and the Illinois | 4 | | Community College Board, in consultation with public | 5 | | institutions of higher education and advocates, may adopt | 6 | | rules concerning the reporting of data to protect student | 7 | | privacy while satisfying the requirements of this Act. | 8 | | Section 25. Family Educational Rights and Privacy Act of | 9 | | 1974. The sharing and reporting of data under this Act must be | 10 | | in accordance with the requirements of the federal Family | 11 | | Educational Rights and Privacy Act of 1974. Nothing in this | 12 | | Act supersedes the federal Family Educational Rights and | 13 | | Privacy Act of 1974 or rules adopted pursuant to the federal | 14 | | Family Educational Rights and Privacy Act of 1974 or any | 15 | | federal or State laws and rules governing student privacy | 16 | | rights.
| 17 | | Section 99. Effective date. This Act takes effect July 1, | 18 | | 2021.
