Amends the Illinois Vehicle Code. Provides that antique vehicles and expanded-use antique vehicles are required to display registration plates on the rear of the vehicle only. Provides that expanded-use antique vehicles may be operated year round with no restriction on destination or purpose.

| 2 | | Be it enacted by the People of the State of Illinois,
| 3 | | represented in the General Assembly:
| 4 | | Section 5. The Illinois Vehicle Code is amended by changing | 5 | | Sections 3-413 and 3-804.01 as follows:
| 6 | | (625 ILCS 5/3-413) (from Ch. 95 1/2, par. 3-413)
| 7 | | Sec. 3-413. Display of registration plates, registration | 8 | | stickers,
and drive-away permits; registration plate covers. | 9 | | (a) Registration plates issued for a
motor vehicle other | 10 | | than an antique vehicle, expanded-use antique vehicle, a | 11 | | motorcycle, trailer, semitrailer,
truck-tractor, apportioned | 12 | | bus, or apportioned truck shall be attached
thereto, one in the | 13 | | front and one in the
rear. The registration plate issued for an | 14 | | antique vehicle, expanded-use antique vehicle, a motorcycle, | 15 | | trailer or
semitrailer required to be registered hereunder and | 16 | | any apportionment
plate issued to a bus under the provisions of | 17 | | this Code shall be attached
to the rear thereof. The | 18 | | registration plate issued for a truck-tractor or
an apportioned | 19 | | truck required to be registered hereunder shall be
attached to | 20 | | the front thereof.
| 21 | | (b) Every registration plate shall at all times be securely | 22 | | fastened
in a horizontal position to the vehicle for which it | 23 | | is issued so as to
prevent the plate from swinging and at a |

| 1 | | height of not less than 5
inches from the ground, measuring | 2 | | from the bottom of such plate, in a
place and position to be | 3 | | clearly visible and shall be maintained in a
condition to be | 4 | | clearly legible, free
from any materials that would obstruct | 5 | | the visibility of the plate. A registration plate on a | 6 | | motorcycle may be mounted vertically as long as it is otherwise | 7 | | clearly visible. Registration stickers issued as
evidence of | 8 | | renewed annual registration shall be attached to registration
| 9 | | plates as required by the Secretary of State, and be clearly | 10 | | visible at
all times.
| 11 | | (c) Every drive-away permit issued pursuant to this
Code | 12 | | shall
be firmly attached to the motor vehicle in the manner | 13 | | prescribed by the Secretary of State. If a drive-away permit is | 14 | | affixed to a motor vehicle in any other manner the
permit shall | 15 | | be void and of no effect.
| 16 | | (d) The Illinois prorate decal issued to a foreign | 17 | | registered
vehicle part of a fleet prorated or apportioned with | 18 | | Illinois, shall be
displayed on a registration plate and | 19 | | displayed on the front of such
vehicle in the same manner as an | 20 | | Illinois registration plate.
| 21 | | (e) The registration plate issued for a camper body mounted | 22 | | on a
truck displaying registration plates shall be attached to | 23 | | the rear of
the camper body.
| 24 | | (f) No person shall operate a vehicle, nor permit the | 25 | | operation of a
vehicle, upon which is displayed an Illinois | 26 | | registration plate, plates
or registration stickers after the |

| 1 | | termination of the registration
period for which issued or | 2 | | after the expiration date set pursuant to
Sections 3-414 and | 3 | | 3-414.1 of this Code.
| 4 | | (g) A person may not operate any motor vehicle that is | 5 | | equipped with registration plate covers. A violation of this | 6 | | subsection (g) or a similar provision of a local ordinance is | 7 | | an offense against laws and ordinances regulating the movement | 8 | | of traffic. | 9 | | (h) A person may not sell or offer for sale a registration | 10 | | plate cover. A violation of this subsection (h) is a business | 11 | | offense. | 12 | | (i) A person may not advertise for the purpose of promoting | 13 | | the sale of registration plate covers. A violation of this | 14 | | subsection (i) is a business offense. | 15 | | (j) A person may not modify the original manufacturer's | 16 | | mounting location of the rear registration plate on any vehicle | 17 | | so as to conceal the registration or to knowingly cause it to | 18 | | be obstructed in an effort to hinder a peace officer from | 19 | | obtaining the registration for the enforcement of a violation | 20 | | of this Code, Section 27.1 of the Toll Highway Act concerning | 21 | | toll evasion, or any municipal ordinance. Modifications | 22 | | prohibited by this subsection (j) include but are not limited | 23 | | to the use of an electronic device. A violation of this | 24 | | subsection (j) is a Class A misdemeanor. | 25 | | (Source: P.A. 97-743, eff. 1-1-13.) |

| 1 | | (625 ILCS 5/3-804.01) | 2 | | Sec. 3-804.01. Expanded-use antique vehicles. | 3 | | (a) The owner of a motor vehicle that is more than 25 years | 4 | | of age or a bona fide replica
thereof may register the vehicle | 5 | | as an expanded-use antique vehicle. In addition to the | 6 | | appropriate registration and renewal fees, the fee for | 7 | | expanded-use antique vehicle registration and renewal shall be | 8 | | $45 per year. The application for
registration must be | 9 | | accompanied by an affirmation of
the owner that: | 10 | | (1) (blank); from January 1 through March 31 and from | 11 | | November 1 through December 31, the vehicle will be driven | 12 | | on the highways only for the purpose
of going to and | 13 | | returning from an antique auto show or an exhibition, or
| 14 | | for servicing or demonstration; and | 15 | | (2) the mechanical
condition, physical condition, | 16 | | brakes, lights, glass, and appearance of such
vehicle is | 17 | | the same or as safe as originally equipped. | 18 | | From April 1 through October 31, a vehicle registered as an | 19 | | expanded-use antique vehicle may be driven on the highways | 20 | | without being subject to the restrictions set forth in | 21 | | subdivision (1). The Secretary may prescribe ,
in the | 22 | | Secretary's discretion, that expanded-use antique vehicle | 23 | | plates be issued for a
definite or an indefinite term, such | 24 | | term to correspond to the term of
registration plates issued | 25 | | generally, as provided in Section 3-414.1. Any person | 26 | | requesting expanded-use antique vehicle plates under this |

may also apply to have vanity or personalized plates as | 2 | | provided under
Section 3-405.1. | 3 | | (b) Any person who is the registered owner of an | 4 | | expanded-use antique vehicle may
display a historical license | 5 | | plate from or representing the model year of
the vehicle, | 6 | | furnished by such person, in lieu of the current and valid
| 7 | | Illinois expanded-use antique vehicle plates issued thereto, | 8 | | provided that the valid and
current Illinois expanded-use | 9 | | antique vehicle plates and registration card issued to
the | 10 | | expanded-use antique vehicle are simultaneously carried within | 11 | | the vehicle and are
available for inspection. | 12 | | (c) The Secretary may credit a pro-rated portion of a fee | 13 | | previously paid for an antique vehicle registration under | 14 | | Section 3-804 to an owner who applies to have that vehicle | 15 | | registered as an expanded-use antique vehicle instead of an | 16 | | antique vehicle.
