|
| 1 | | AN ACT concerning transportation.
| 2 | | Be it enacted by the People of the State of Illinois,
| 3 | | represented in the General Assembly:
| 4 | | Section 5. The Illinois Vehicle Code is amended by | 5 | | changing Sections 11-904 and 11-1204 as follows:
| 6 | | (625 ILCS 5/11-904) (from Ch. 95 1/2, par. 11-904)
| 7 | | Sec. 11-904. Vehicle entering stop or yield intersection.
| 8 | | (a) Preferential right-of-way at an intersection may be | 9 | | indicated by
stop or yield signs as authorized in Section | 10 | | 11-302 of this Chapter.
| 11 | | (b) Except when directed to proceed by a police officer or | 12 | | traffic control
traffic-control signal, every driver of a | 13 | | vehicle approaching a stop
intersection indicated by a stop | 14 | | sign shall stop at a clearly marked stop
line, but if none, | 15 | | before entering the crosswalk on the near side of the
| 16 | | intersection, or if none, then at the point nearest the | 17 | | intersecting
roadway where the driver has a view of | 18 | | approaching traffic on the
intersecting roadway before | 19 | | entering the intersection. After having
stopped, the driver | 20 | | shall yield the right-of-way to any vehicle which has
entered | 21 | | the intersection from another roadway or which is approaching | 22 | | so

when the driver is moving across or within the |

| 1 | | intersection, but said
driver having so yielded may proceed at | 2 | | such time as a safe interval
occurs.
| 3 | | (c) The driver of a vehicle approaching a yield sign shall | 4 | | in obedience
to such sign slow down to a speed reasonable for | 5 | | the existing conditions
and, if required for safety to stop, | 6 | | shall stop at a clearly marked stop
line, but if none, before | 7 | | entering the crosswalk on the near side of the
intersection, | 8 | | or if none, then at the point nearest the intersecting
roadway | 9 | | where the driver has a view of approaching traffic on the
| 10 | | intersecting roadway. After slowing or stopping, the driver | 11 | | shall yield the
right-of-way to any vehicle in the | 12 | | intersection or approaching on another
roadway so closely as | 13 | | to constitute an immediate hazard during the time
such driver | 14 | | is moving across or within the intersection.
| 15 | | (d) If a driver is involved in a collision at an | 16 | | intersection or
interferes with the movement of other vehicles | 17 | | after driving past a yield
right-of-way sign, such collision | 18 | | or interference shall be deemed prima
facie evidence of the | 19 | | driver's failure to yield right-of-way.
