| 1 | | AN ACT concerning transportation.
| 2 | | Be it enacted by the People of the State of Illinois,
| 3 | | represented in the General Assembly:
| 4 | | Section 5. The Illinois Vehicle Code is amended by changing | 5 | | Sections 3-413 and 3-701 as follows:
| 6 | | (625 ILCS 5/3-413) (from Ch. 95 1/2, par. 3-413)
| 7 | | Sec. 3-413. Display of registration plates, registration | 8 | | stickers,
and drive-away permits; registration plate covers. | 9 | | (a) Registration plates issued for a
motor vehicle other | 10 | | than a motorcycle, trailer, semitrailer,
truck-tractor, | 11 | | apportioned bus, or apportioned truck shall be attached
| 12 | | thereto, one in the front and one in the
rear. The registration | 13 | | plate issued for a motorcycle, trailer or
semitrailer required | 14 | | to be registered hereunder and any apportionment
plate issued | 15 | | to a bus under the provisions of this Code shall be attached
to | 16 | | the rear thereof. The registration plate issued for a | 17 | | truck-tractor or
an apportioned truck required to be registered | 18 | | hereunder shall be
attached to the front thereof.
| 19 | | (b) Every registration plate shall at all times be securely | 20 | | fastened
in a horizontal position to the vehicle for which it | 21 | | is issued so as to
prevent the plate from swinging and at a | 22 | | height of not less than 5
inches from the ground, measuring | 23 | | from the bottom of such plate, in a
place and position to be |

| 1 | | clearly visible and shall be maintained in a
condition to be | 2 | | clearly legible, free
from any materials that would obstruct | 3 | | the visibility of the plate. A registration plate on a | 4 | | motorcycle may be mounted vertically as long as it is otherwise | 5 | | clearly visible. Registration stickers issued as
evidence of | 6 | | renewed annual registration shall be attached to registration
| 7 | | plates as required by the Secretary of State, and be clearly | 8 | | visible at
all times.
| 9 | | (c) Every drive-away permit issued pursuant to this
Code | 10 | | shall
be firmly attached to the motor vehicle in the manner | 11 | | prescribed by the Secretary of State. If a drive-away permit is | 12 | | affixed to a motor vehicle in any other manner the
permit shall | 13 | | be void and of no effect.
| 14 | | (d) The Illinois prorate decal issued to a foreign | 15 | | registered
vehicle part of a fleet prorated or apportioned with | 16 | | Illinois, shall be
displayed on a registration plate and | 17 | | displayed on the front of such
vehicle in the same manner as an | 18 | | Illinois registration plate.
| 19 | | (e) The registration plate issued for a camper body mounted | 20 | | on a
truck displaying registration plates shall be attached to | 21 | | the rear of
the camper body.
| 22 | | (f) No person shall operate a vehicle, nor permit the | 23 | | operation of a
vehicle, upon which is displayed an Illinois | 24 | | registration plate, plates
or registration stickers , except as | 25 | | provided for in subsection (b) of Section 3-701 of this Code, | 26 | | after the termination of the registration
period for which |

| 1 | | issued or after the expiration date set pursuant to
Sections | 2 | | 3-414 and 3-414.1 of this Code.
| 3 | | (g) A person may not operate any motor vehicle that is | 4 | | equipped with registration plate covers. A violation of this | 5 | | subsection (g) or a similar provision of a local ordinance is | 6 | | an offense against laws and ordinances regulating the movement | 7 | | of traffic. | 8 | | (h) A person may not sell or offer for sale a registration | 9 | | plate cover. A violation of this subsection (h) is a business | 10 | | offense. | 11 | | (i) A person may not advertise for the purpose of promoting | 12 | | the sale of registration plate covers. A violation of this | 13 | | subsection (i) is a business offense. | 14 | | (j) A person may not modify the original manufacturer's | 15 | | mounting location of the rear registration plate on any vehicle | 16 | | so as to conceal the registration or to knowingly cause it to | 17 | | be obstructed in an effort to hinder a peace officer from | 18 | | obtaining the registration for the enforcement of a violation | 19 | | of this Code, Section 27.1 of the Toll Highway Act concerning | 20 | | toll evasion, or any municipal ordinance. Modifications | 21 | | prohibited by this subsection (j) include but are not limited | 22 | | to the use of an electronic device. A violation of this | 23 | | subsection (j) is a Class A misdemeanor. | 24 | | (Source: P.A. 97-743, eff. 1-1-13.)

| 1 | | Sec. 3-701. Operation of vehicles without evidence of
| 2 | | registration - Operation under mileage plates when odometer | 3 | | broken or
disconnected. | 4 | | (a) No person shall operate, nor shall an owner knowingly | 5 | | permit to
be
operated, except as provided in subsection (b) of | 6 | | this Section, upon any highway unless there shall be attached | 7 | | thereto and
displayed thereon when and as required by law, | 8 | | proper evidence of
registration in Illinois, as follows:
| 9 | | (1) A vehicle required to be registered in Illinois. A | 10 | | current and
valid Illinois registration sticker or | 11 | | stickers and plate or plates, or
an Illinois temporary | 12 | | registration permit, or a drive-away or
in-transit permit, | 13 | | issued therefor by the Secretary of State; or
| 14 | | (2) A vehicle eligible for Reciprocity. A current and | 15 | | valid
reciprocal foreign registration plate or plates | 16 | | properly issued to such
vehicle or a temporary registration | 17 | | issued therefor, by the reciprocal
State, and, in addition, | 18 | | when required by the Secretary, a current and
valid | 19 | | Illinois Reciprocity Permit or Prorate Decal issued
| 20 | | therefor by the Secretary of State; or except as otherwise | 21 | | expressly
provided for in this Chapter.
| 22 | | (b) A person may operate or permit operation of a vehicle | 23 | | upon any highway a vehicle that has been properly registered | 24 | | but does not display a current and valid Illinois registration | 25 | | sticker if he or she has proof, in the form of a printed | 26 | | receipt from the Secretary, that he or she registered the |

| 1 | | vehicle before the previous registration's expiration but has | 2 | | not received a new registration sticker from the Secretary. | 3 | | This printed proof of registration is valid for 30 days from | 4 | | the expiration of the previous registration sticker's date. | 5 | | (c) No person shall operate, nor shall any owner knowingly | 6 | | permit to be
operated, any vehicle of the second division for | 7 | | which the owner has
made an election to pay the mileage tax in | 8 | | lieu of the annual flat
weight tax, at any time when the | 9 | | odometer of such vehicle is broken or
disconnected, or is | 10 | | inoperable or not operating.
