Amends the Board of Higher Education Act. Provides that the funding for the allocations to public institutions of higher education based upon performance metrics for Fiscal Year 2015 must be at least 0.5% above Fiscal year 2014's funding and, for each of Fiscal Years 2016 through 2019, must be at least 1% above the previous fiscal year's funding. Effective immediately.

| 2 | | Be it enacted by the People of the State of Illinois,
| 3 | | represented in the General Assembly:
| 4 | | Section 5. The Board of Higher Education Act is amended by | 5 | | changing Section 8 as follows:

| 7 | | Sec. 8.
The Board of Trustees of the University of | 8 | | Illinois, the Board of
Trustees of Southern Illinois | 9 | | University,
the Board of Trustees of Chicago State University, | 10 | | the Board of Trustees of
Eastern Illinois University, the Board | 11 | | of Trustees of Governors State
University, the Board of | 12 | | Trustees of Illinois State University, the Board of
Trustees of | 13 | | Northeastern Illinois University, the Board of Trustees of | 14 | | Northern
Illinois University, the Board of Trustees of Western | 15 | | Illinois University, and
the Illinois Community College Board | 16 | | shall submit to the Board not later
than the 15th day of | 17 | | November of each year its budget proposals for the
operation | 18 | | and capital needs of the institutions under its governance or
| 19 | | supervision for the ensuing fiscal year. Each budget proposal | 20 | | shall conform
to the procedures developed by the Board in the | 21 | | design of an information
system for State universities and | 22 | | colleges.
| 23 | | In order to maintain a cohesive system of higher education, |

| 1 | | the Board and
its staff shall communicate on a regular basis | 2 | | with all public university
presidents. They shall meet at least | 3 | | semiannually to achieve economies of
scale where possible and | 4 | | provide the most innovative and efficient programs and
| 5 | | services.
| 6 | | The Board, in the analysis of formulating the annual budget | 7 | | request,
shall consider rates of tuition and fees and | 8 | | undergraduate tuition and fee waiver programs at the state | 9 | | universities and
colleges. The Board shall also consider the | 10 | | current and projected
utilization of the total physical plant | 11 | | of each campus of a university or
college in approving the | 12 | | capital budget for any new building or facility.
| 13 | | The Board of Higher Education shall submit to the Governor, | 14 | | to the
General Assembly, and to the appropriate budget agencies | 15 | | of the Governor
and General Assembly its analysis and | 16 | | recommendations on such budget
proposals.
| 17 | | The Board is directed to form a broad-based group of | 18 | | individuals representing the Office of the Governor, the | 19 | | General Assembly, public institutions of higher education, | 20 | | State agencies, business and industry, Statewide organizations | 21 | | representing faculty and staff, and others as the Board shall | 22 | | deem appropriate to devise a system for allocating State | 23 | | resources to public institutions of higher education based upon | 24 | | performance in achieving State goals related to student success | 25 | | and certificate and degree completion. | 26 | | Beginning in Fiscal Year 2013, the Board of Higher |

| 1 | | Education budget recommendations to the Governor and the | 2 | | General Assembly shall include allocations to public | 3 | | institutions of higher education based upon performance | 4 | | metrics designed to promote and measure student success in | 5 | | degree and certificate completion. These metrics must be | 6 | | adopted by the Board by rule and must be developed and | 7 | | promulgated in accordance with the following principles: | 8 | | (1) The metrics must be developed in consultation with | 9 | | public institutions of higher education, as well as other | 10 | | State educational agencies and other higher education | 11 | | organizations, associations, interests, and stakeholders | 12 | | as deemed appropriate by the Board. | 13 | | (2) The metrics shall include provisions for | 14 | | recognizing the demands on and rewarding the performance of | 15 | | institutions in advancing the success of students who are | 16 | | academically or financially at risk, including | 17 | | first-generation students, low-income students, and | 18 | | students traditionally underrepresented in higher | 19 | | education, as specified in Section 9.16 of this Act. | 20 | | (3) The metrics shall recognize and account for the | 21 | | differentiated missions of institutions and sectors of | 22 | | higher education. | 23 | | (4) The metrics shall focus on the fundamental goal of | 24 | | increasing completion of college courses, certificates, | 25 | | and degrees. Performance metrics shall recognize the | 26 | | unique and broad mission of public community colleges |

| 1 | | through consideration of additional factors including, but | 2 | | not limited to, enrollment, progress through key academic | 3 | | milestones, transfer to a baccalaureate institution, and | 4 | | degree completion. | 5 | | (5) The metrics must be designed to maintain the | 6 | | quality of degrees, certificates, courses, and programs. | 7 | | In devising performance metrics, the Board may be guided by the | 8 | | report of the Higher Education Finance Study Commission. The | 9 | | funding for the allocations to public institutions of higher | 10 | | education based upon performance metrics for Fiscal Year 2015 | 11 | | must be at least 0.5% above Fiscal Year 2014's funding and, for | 12 | | each of Fiscal Years 2016 through 2019, must be at least 1% | 13 | | above the previous fiscal year's funding. | 14 | | Each state supported institution within the application of | 15 | | this Act must
submit its plan for capital improvements of | 16 | | non-instructional facilities to
the Board for approval before | 17 | | final commitments are made if the total cost of the project as | 18 | | approved by the institution's board of control is in excess of | 19 | | $2 million. Non-instructional
uses shall include but not be | 20 | | limited to dormitories, union buildings,
field houses, | 21 | | stadium, other recreational facilities and parking lots. The
| 22 | | Board shall determine whether or not any project submitted for | 23 | | approval is
consistent with the master plan for higher | 24 | | education and with instructional
buildings that are provided | 25 | | for therein. If the project is found by a
majority of the Board | 26 | | not to be consistent, such capital improvement shall
